Description

The U. S. Department of Commerce (DOC), National Institute of Standards and Technology (NIST), on behalf of DOC National Technical Information Service (NTIS), intends to negotiate and award a sole source contract to Adobe Systems, Inc. of Vienna, VA for the right to replicate Adobe Approval 5.0 software onto Federal Tax Product CD-ROM's and Small Business Resource Guide CD-ROM's. Adobe Sytems, Inc. owns the copyright to Adobe Approval 5.0 software, and is the only company that can enter into a contract with the Government to authorize the Government to replicate that software. The contract will be a 3-year, indefinite-delivery, indefinite-quantity contract, and will be awarded under Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items. The minimum guarantee for the contract will be $850,000.00 in contract year one only. The maximum value of the contract will be $5,000,000.00. The scope of the contract also could include the right to modify the contract to allow the Government to acquire the right to replicate Adobe software products that replace Adobe Approval 5.0 software which are not yet available in the marketplace.
