Description

The National Institute of Standards and Technology (NIST) intends to issue a purchase order, on a sole-source basis under the authority of 13.106-1(b), to Avanti Corporation, 46871 Bayside Parkway, Fremont, CA, 94538 for the continued annual maintenance and support of its proprietary software, Server-Flex, installed at NIST. As proprietor of the software, Avanti Corporation is the only known source that can provide the required upgrade, support, and maintenance. The associated North American Industrial Classification System (NAICS) code for this procurement is 511210 and the related size standard is $18 million. All responsible sources may identify their interest and capability to satisfy this requirement and must provide written documentation stating that they are authorized by Avanti Corporation to provide the needed software upgrade, support, and maintenance. This notice of intent is not a request for competitive quotes; no competitive solicitation will be issued; however, the Government will consider all quotes or other information received by 11/30/01. Information received will normally be considered solely to determine whether to conduct a competitive procurement. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Contracting Officer. The Government anticipates awarding a firm-fixed-price purchase order as a result of this requirement.
