- Request for Information (RFI) The Defense Supply Center Philadelphia's (DSCP) Subsistence Directorate is currently endeavoring to ensure compliance with the Berry Amendment; this Berry Amendment, which is codified at 10 U.S.C. 2241, note requires food items to be of domestic origin, of domestic content, and manufactured in the U.S. or its possessions unless a determination is made that the product cannot be acquired as and when needed in satisfactory quality and sufficient quantity at U.S. market prices. The Berry Amendment is implemented in the Defense Federal Acquisition Regulation Supplement (DFARS) at Part 225.7002. Exceptions to Berry Amendment restrictions are listed at DFARS 225.7002-2. Nonavailable articles are listed at FAR 25.104. As part of this effort, DSCP is seeking input from any Subsistence related trade organization which represents food suppliers and/or manufacturers to help determine the domestic availability of any food items supplied to Department of Defense customers under Federal Acquisition Regulation Part 12, to include DSCP's Subsistence Prime Vendor program. For additional information about this program, please see DSCP's website at www.dscp.dla.mil and click on Subsistence icon, then on Food Service icon. Specifically, DSCP seeks information on processes currently in place or which could be implemented to establish and track the source of origin of every subsistence item sold through DSCP's Subsistence contracts, including specific ingredients, components or raw materials of processed items, as well as whole items, along with the place of processing of these ingredients, components, raw materials or whole items. The estimated costs for research required in determining the source of ingredients, components, raw materials, or whole end items as outlined in this RFI may be included in your response. There is no format requirement for information submitted under this Request. At this time, DSCP does not intend to award a contract resulting from information obtained under this request, nor does it intend at this time to pay for any information received under this request or for any preparation costs related to responses received.=20 Initial responses to this request, indicating an interest in this topic and a willingness to participate, are due to DSCP 45 days after publication of this request. Since this is an ongoing need, DSCP does not anticipate establishing a final closing or "required by" date for responses; however, should DSCP's needs change, a new notice will be posted detailing this.
