Description

This is notification that the U.S. EPA plans to negotiate a sole source contract with Eastern Research Group to complete the implementation of industrial point-source category effluent limitations guidelines and standards for the Iron and Steel Industry. This action will be completed by means of a cost plus, level of effort, contract with a 12 month period of performance. Effluent limitation guidelines and standards are industry specific. Any potential offeror would have to demonstrate that it has a thorough knowledge and understanding of the rule making process together with an intimate knowledge of the industry to be regulated. These effluent guidelines are mandated by the Clean Water Act and are under stringent court ordered schedules. Negotiations will be conducted pursuant to the authority of 42 U.S.C. 253 (c) (1), which allows for negotiations without full and open competition if there is only one responsible source. The basis for this determination is that only ERG possesses the industry specific expertise vital to the EPA as it brings the regulatory process for the Iron and Steel industry to its ultimate conclusion. THIS IS NOT A REQUEST FOR PROPOSALS. Sources wishing to be considered must submit documentation to the office identified above which establishes that (1) the company has the Iron and Steel industry expertise necessary to meet the contract technical requirements; (2) it has a thorough knowledge and understanding of the rule making process; and (3) that it can provide continuity of services with a coherent and consistent understanding of the rule making record developed over the last several years. Documentation should be submitted within 15 calendar days of publication of this notice. See Notes 22 and 26.
