- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation, N00173-01-R-MS07, is issued as a Request for Proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-27 and DFARS Change Notice 20001213. The associated NAICS code is 332311 all business size standard is 500 employees. NRL has a requirement for ISO type shelters. The shelters are to be used to house equipment for use with the Advanced Multifunction Radio Frequency Concept (ADMRF). The description of requirements is provided as Attachment (1), Specifications for ISO Shelters, at the following web site address: http://heron.nrl.navy.mil/contracts/rfplist.htm. Delivery and acceptance is at the Naval Research Laboratory, 4555 Overlook Ave. SW, Washington, D.C., 20375, FOB Destination. Delivery for the first shelter shall be no later than 90 days from date of award with the next shelters to be delivered in one month integrals. The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. The provision at FAR 52.212-2, Evaluation -- Commercial Items is incorporated and the Government intends to award a contract resulting from this solicitation to that responsible offeror whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate the offers: (i) technical capability of the item offered to meet the Government requirement; (ii) past performance and (iii) price. Technical and past performance, when combined, are more important then price. Offeror must complete and submit with its proposal, FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items and DFARS 252.212-7000 Offeror Representations and Certifications -- Commercial Items., which are available electronically at : http://heron.nrl.navy.mil/contracts/reps&certs.htm. The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Items and FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition. Addenda to clause FAR 52.212-5, adding the following clauses: FAR 52.203-8, Cancellation, Rescission, and Recovery of Funds for Illegal or Improper Activity (JAN 1997); 52.203-10, Price or Fee Adjustment for Illegal or Improper Activity (JAN 1997), and 52.211-6, Brand Name Or Equal (AUG 1999). The DFARS clauses at 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items is applicable. The additional DFARS clauses cited in the clause are applicable: 252.225-7007, Buy American Act -Trade Agreements -- Balance of Payments Program (41 U.S.C. 10a-10d, 19 U.S.C.2501-2518 and 19 U.S.C. 3301 note); 252.225-7012, Preference for Certain Domestic Commodities, 252.225-7014; Preference for Domestic Specialty Metals (10 U.S.C.2241 note); and 252.247-7024, Notification of Transportation of Supplies by Sea (10 U.S.C.2631). The following additional DFARS clause applies: 252.204-7004, Required Central Contractor Registration (MAR 2000). The following provision applies: Electronic and Information Technology (EIT). In accordance with Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), all EIT supplies and services provided under this contract must comply with the applicable accessibility standards issued by the Architectural and Transportation Barriers Compliance Board at 36 CFR part 1194 (see FAR Subpart 39.2). Electronic and information technology (EIT) is defined at FAR 2.101. Any resultant contract will be a DO Rated order under the Defense Priorities and Allocations System (DPAS). The Contract Specialist must receive any questions no later than 10 calendar days before the closing date of the proposal. An original and two (2) copies of the offeror's proposal shall be delivered to Contracting Officer, Bldg. 222, Room 115, Naval Research Laboratory, 4555 Overlook Ave. SW Washington, D.C. 20375-5326 on or before 4:00PM, local time, September 5, 2001. The package should be marked with the solicitation number and due date and time.
