- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) intends to award a firm fixed-price contract in response to Request for Proposal (RFP) 244-01-0011. This acquisition is issued on an unrestricted basis pursuant to the Small Business Competitiveness Demonstration Program Act of 1988 (Public Law 100-656 (15 U.S.C. 644)). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-27. The associated North American Industry Classification System code is 562219 and the small business size standard is $10 million. The PRICE/COST SCHEDULE consists of 4 contract line item numbers (CLIN): CLIN 1 Biosolids Testing; Quantity 1; Unit of Issue Lump Sum; Total Amount -- $____________. CLIN 2 Mobilization/Demobilization; Quantity 1; Unit of Issue Lump Sum; Total Amount -- $____________. CLIN 3 Removal/Transport of Biosolids; Quantity 2 million; Unit of Issue Gallons; Total Amount -- $____________. CLIN 4 Land Application of Biosolids, OPTION A: Injection; Quantity 2 million; Unit of Issue Gallons; Total Amount -- $____________; OPTION B: Direct Application; Quantity 2 million; Unit of Issue Gallons; Total Amount -- $____________; Grand Total: OPTION A -- $____________; Grand Total: OPTION B -- $____________. SCOPE OF WORK: TP-1.1 Scope: This specification describes all work and materials, plant, labor, and equipment required to complete sludge removal at the Lodge Grass wastewater treatment facility on the Crow Indian Reservation, Montana. The work shall include, but not be limited to, biosolid testing prior to removal, removal of excess biosolids from cell #1, delivery to field for land treatment, and land treatment of biosolids. TP-1.5.2: Work hours will be 8:00 a.m. to 5:00 p.m. local time, Monday though Friday, excluding Federal and Tribal Holidays, unless otherwise agreed to by the Project Officer. Prior to performing work outside these hours, the Contractor must have written consent from the Project Officer. TP-1.7: Submittals are required from the Contractor and shall be approved by the Project Officer for the following items: (1) Work schedule; (2) Biosolids testing results; and (3) Final report. A minimum of 4 sets of submittals shall be required. Three Project Officer approved sets shall be retained by the IHS and one approved set shall be returned to the Contractor. TP-1.8: A Post Award Conference shall be held prior to starting work. At this conference, the plans, specifications and project scope shall be reviewed, a Notice-to-Proceed date shall be established, the work schedule shall be discussed, and any other issues pertaining to the project shall be covered. TP-1.9: A work schedule shall be mutually agreed upon between the Contractor and the Project Officer. The schedule shall be submitted in writing to the Project Officer at the Post Award Conference. TP-1.10: A Notice-to-Proceed will be given, in writing, by the Contracting Officer. TP-1.11: The length of the contract will be 45 calendar days from the Notice-to-Proceed date. TP-1.21: The quantities listed in the Price/Cost Schedule are the best estimates available at this time. TP-1.22 Pay Requests: TP-1.22.1 Submission: Pay requests shall be returned if incomplete or incorrect. Pay requests shall include an invoice, payroll sheets and information required by the Project Officer. TP-83.2 Biosolids Sampling and Testing: The Contractor shall obtain samples of biosolids and shall have a qualified laboratory perform the following tests. Testing shall meet all applicable EPA regulations. TP-83.2.1 Fecal Coliforms: A minimum of seven samples shall be obtained for fecal coliform testing. The tests shall report fecal coliforms on a dry weight basis in MPN/g for each sample and a geometric mean of the samples. TP-83.2.2 Solids: The sludge shall be tested for total and volatile solids. TP-83.2.3 Nutrients: The sludge shall be tested for total, organic, ammonia, nitrate and nitrite nitrogen on a dry matter basis. The sludge shall also be tested for total phosphorus and potassium on a dry matter basis. TP-83.2.4 Metals: The sludge shall be tested for the following metals, and reported as mg/kg on a dry matter basis: cadmium, copper, lead, nickel, zinc, arsenic, mercury, molybdenum, and selenium. TP-83.2 Biosolids Removal: The Contractor shall remove biosolids from the bottom of cell #1 of the Lodge Grass Lagoon. The Contractor shall use a dredge, or other means of removing sludge such that the facility shall remain in operation during biosolids removal. TP-83.2 Transportation of Biosolids: The Contractor shall transport biosolids to land treatment site using sealed tanker trucks. The Contractor shall obtain all necessary permits for transport of biosolids. The biosolids shall be transported for application at the locations shown on sheet #2 as directed by Project Officer. TP-83.3 Application of Biosolids: The Contractor shall apply biosolids to land at the rate specified by the Project Officer. Based on preliminary information, the estimated application rates are 19,000 gallons of sludge per acre of wheat, and 10,000 gallons of sludge per acre of alfalfa. The actual application rate shall be determined after analysis of biosolids testing. The Contractor shall apply the biosolids using one of the following options as selected by the Project Officer: TP-83.3.1 Injection: If this option is selected, the Contractor shall apply the biosolids using a high floatation tire injection applicator. Under this option, no significant amount of biosolids may be present on the land surface within one hour. TP-83.3.2 Incorporation: If this option is selected, the Contractor shall apply the biosolids directly to the land. The landowner or lessee shall incorporate the biosolids into the soil within 6 hours of application using appropriate tilling or plowing equipment. TP-83.4 Biosolids Spills: The Contractor shall be responsible for cleaning all biosolids spills. TP-83.5 Environmental Regulations: All operations shall conform to the most recent tribal, state, and federal environmental regulations. TP-200.1 General: The quantity of each item listed on the Price/Cost Schedule shall be measured, counted or otherwise determined according to the units specified by this section of the technical provisions for that item. Payment shall be based on work performed in accordance with the drawing and specifications of this contract at the respective contract unit price for each item listed on the Price/Cost Schedule. TP-200.2 Payment Items: TP-200.2.1 Sludge Testing: Payment shall be made at a lump sum for testing of sludge prior to biosolids removal. TP-200.2.2 Mobilization and Demobilization: Payment shall be made for mobilization and demobilization to and from the project site. TP-200.2.3 Biosolids removal: Payment shall be made per gallon of biosolids removed from wastewater treatment lagoon. Payment for removal shall also include transportation to final application site. TP-200.2.4 Land Application: Payment shall be made per gallon of biosolids applied to farmland. The Contractor shall provide an offer for each land application option. The Project Officer shall select the application option to be used, and payment shall be made at the applicable price for selected option. TP-200.3 Nonpayment items: TP-200.3.2 Biosolids Transportation: Transportation of biosolids from lagoon to application site shall not be paid for separately, but shall be considered as subsidiary to and a part of the cost of the applicable contract line item. TP-3.3 Cleanup: Cleanup of the jobsite shall not be paid for separately, but shall be considered as subsidiary to and a part of the cost of the applicable contract line item. SERVICE CONTRACT ACT: Wage Determination 94-2317, Revision 15, dated 05/31/01 applies to this acquisition. The occupational titles applicable are: Laborer $8.09 and Truck Driver, $9.13 -- $16.09. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The Federal Acquisition Regulation (FAR) provision 52.212-1 Instructions to Offerors Commercial Items; and 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 Evaluation -- Commercial Items (Jan 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers and are included in the relative order of importance: (1) Cost; (2) Experience of key personnel. The Contractor shall provide a list of the key personnel to perform the work and a summary of their qualifications; (3) Equipment. The Contractor shall provide a list of the proposed equipment; and (4) Past Performance. The Contractor shall provide a list of at least 5 similar or larger biosolids land application projects, including the name of the business concern and the year of completion. Technical and past performance, when combined, are approximately equal to cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The following FAR and Health and Human Services Acquisition Regulation (HHSAR) clauses are applicable: 52.204-4 Printed or Copied Double-Sided on Recycled Paper; 52.211-16 Variation in Quantity (10 percent and (3) each quantity specified in the Price/Cost schedule); 52.212-4 Contract Terms and Conditions Commercial Items, 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items, 52.232-18 Availability of Funds; 52.237-3 Protection of Government Buildings, Equipment, and Vegetation; 52.242-17 Government Delay of Work; 352.223-70 Safety and Health; 352.232-9 Withholding of Contract Payments; 352.270-2 Indian Preference; 352.270-3 Indian Preference Program; 352.270-4 Pricing of Adjustments; 352.270-6 Publications and Publicity; and 352.270-7 Paperwork Reduction Act. TRIBAL EMPLOYMENT RIGHTS OFFICE (TERO) COMPLIANCE: Notice is hereby given that Contractors who perform projects on the Crow Indian Reservation, Big Horn County, Montana, must be certified through the TERO Office prior to award. The Contractor is also responsible for payment of the tribal taxes, work permits and compliance with the local TERO ordinances. PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide a written response to the technical evaluation factors in 52.212-2 and submit a completed copy of FAR provision 52.212-3 with its offer. The offeror shall agree to hold the prices in its offer firm for 120 days from the date specified for receipt of offers. Offers shall be submitted to the Billings Area Indian Health Service, 2900 Fourth Avenue North, Room 304, Billings, Montana 59101, no later than 2:00 p.m., on September 4, 2001.
