Description
This is a sole source combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR), Subpart 12.6, as supplemented with additional information included in this notice. This solicitation shall be performed under subpart 13.5, Test Program for Certain Commercial Items. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation N00421-01-R-0381 is issued as a request for proposal (RFP). The Government intends to purchase on a firm fixed-price basis a maximum of thirty (30) Fischer Panda 15KW Generator Sets under an Indefinite-Delivery Indefinite-Quantity (IDIQ) contract. The minimum guaranteed quantity will be ten (10) units and maximum amount of thirty (30) units with three one-year (1) ordering periods for a total ordering period of three (3) years. THE DEPARTMENT OF THE ARMY, DoD PROJECT MANAGER-MOBILE ELECTRONIC POWER HAS APPROVED A WAIVER FOR TEN (10) UNITS. ADDITIONAL UNITS ABOVE TEN (10) ORDERED AS THE MINIMUM QUANTITY UNDER THIS CONTRACT MUST HAVE A WAIVER FROM THE DEPARTMENT OF THE ARMY, DOD PROJECT MANAGER-MOBILE ELECTRONIC POWER. The applicable NAICS is 335312 and the small business size standard is 1,000 employees. This action is a sole source under FAR 6.302-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). The equipment will support additional Air Mobility Command requirements and therefore must be form, fit and functionally identical to the Fischer Panda 15KW generator sets previously fielded. The contract line item numbers and descriptions are: CLIN 0001-Fischer Panda 15KW Generator Sets (P/N: PSC15/10.5), Qty 10 each; CLIN 0002-Data to Support CLIN 0001, Operators Manual, Qty 10 each; CLIN 0101-Fischer Panda 15KW Generator Sets (P/N: PSC15/10.5), Qty 10 each; CLIN 0102-Data to Support CLIN 0101, Operators Manual, Qty 10 each; CLIN 0201-Fischer Panda 15KW Generator Sets (P/N: PSC15/10.5), Qty 10 each; CLIN 0202-Data to Support CLIN 0201, Operators Manual, Qty 10 each. Operator Manual in Contractor Format with one (1) for each Generator Set delivered. Award is expected to be 30 August 2001. FOB Destination to Receiving Officer, NAWCAD, Bldg. 8115, Villa Rd., St. Inigoes, MD 20684-0010, M/F: B. Kunes. Inspection and acceptance shall be made at destination. The contractor shall extend to the Government full coverage of any standard commercial warranty normally offered in a similar commercial sale. Acceptance of the warranty does not waive the Government's rights under the Inspection clause, nor does it limit the Government's rights with regard tot he other terms and conditions of this contract. In the event of a conflict the terms and conditions of the contract shall take precedence over the warranty. The warranty period shall begin upon final acceptance of the applicable deliverable listed in the schedule. The incorporated document and provisions and clauses are those in effect through FAC 97-27 and DCN 20001213. FAR 52.212-1, INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS (OCT 2000) and FAR 52.212-4, CONTRACT TERMS AND CONDITIONS COMMERCIAL ITEMS (MAY 2001) are incorporated by reference and apply to this acquisition. FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS COMMERCIAL ITEMS (MAY 2001) applies to this acquisition. This sole source combined synopsis/solicitation is not a request for competitive proposals. However, responsible interested parties may submit a proposal in which they identify their interest and business size.
