- Non-personal Services: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number DABT39-01-T-0102 is being issued as a Request for Quotation. This acquisition is 100% set aside for small business. The applicable North American Industry Classification System (NAICS) code is 561730 (SIC equivalent is 0783); size standard is $5.0 million. A firm-fixed price contract is contemplated and is subject to availability of funds; there is also a possibility that not all contract line items will be awarded. CLIN 0001: Non-personal services. Furnish labor, tools, equipment, and supplies necessary to remove hazardous and dead trees and tree limbs in and around Fort Sill, OK cantonment areas and the Fort Sill, OK golf course in accordance with the terms, conditions, maps and the scope of work contained herein. CLIN 0001AA. Cantonment Area, remove dead and broken limbs and trees and take to a designated area for waste disposal, Qty: 1,100 each; extended price $_____; CLIN 0001AB Cantonment Area, remove stump and fill void with top soil and sod after removal, Qty: 112 each; extended price $_____; CLIN 0001AC Cantonment Area, remove tree completely and dispose of waste. Contractor shall remove stump and fill with top soil and sod area where stump was removed, Qty: 225 each; extended price $_____; CLIN 0001AD, Fort Sill Golf Course (Pre-Priced Option), remove dead and broken limbs from trees and take to a designated area for waste disposal, Qty: 33 each; extended price $_____; CLIN 0001AE, Fort Sill Golf Course (Pre-Priced Option), remove stump and fill void with top soil and sod after removal, Qty: 75 each; extended price $_____. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-27. The following provisions and clauses apply this acquisition: 52.212-1, Instructions to Offerors-Commercial Items; 52.212-4, Contract Terms and Conditions-Commercial Items; A copy of completed FAR provision 52.212-3, Offeror Representations and Certifications-Commercial Items shall be submitted with the offer. 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Order -- Commercial Items (Deviation) with the following clauses as listed 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.232-36 (the paying bank-third party is US Bank, IMPAC Payment Services, PO Box 6347, Fargo, ND 58125-6347, 52.222-41 (subcontracts for certain commercial services may be exempt from coverage if they meet the criteria in FAR 22.1003-4(c) or (d) (see DoD class deviation number 2000-00006). 52.219-6, 52.252-1, 52.252-1 Provisions Incorporated by Reference, 52.252-2 Clauses Incorporated by Reference (access the following websites for full text: http://www.arnet.gov/far; http://farsite.hill.af.mil, 52.252-6 Authorized Deviations in Clauses, 252.212-7000 Offeror Representations and Certifications -- Commercial Items (must submit a completed copy with offer), 252.212-7001 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items with the following clauses as listed: 252-225-7001. Additional FAR and DFARS clauses that are applicable to this acquisition are: 52.223-5, 52.228-5, 52.232-18, 252.204-7004, and 252.201-7000. ADDENDUM to 52.212-4: paragraph (a) is tailored to add the following before the last sentence of this paragraph. The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work. If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the service again in conformity with contract requirements at no increase in contract price. When the defects in services cannot be corrected by re-performance, the Government may-require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and reduce the contract price to reflect the reduced value of the services performed; paragraph (c) is deleted and replaced with the following: Changes in terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes such as changes in paying office, appropriation data, etc., which may be made unilaterally by the Government. WAGE DETERMINATION: The applicable Wage Determination for this acquisition is WD 1994-2525 Rev. 20 and is available for viewing at website mentioned below, Contractual Authority: No written or oral statement of any person whosoever other than the Contracting Officer will, in any manner or degree, modify or otherwise affect the terms of this contract. The Contracting Officer is the only person authorized to approve changes in any of the requirements under this contract, and notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely with the Contracting Officer. EQUIVALENT RATES FOR FEDERAL HIRES: (see paragraph (c)(2) of FAR Clause 52.212-5). This statement is for information only; it is not a wage determination, the class of employee, should this work be performed by the Government would be Laborer at an hourly wage of $9.32 with 32.85% markup for fringe benefits. FAIR LABOR STANDARDS ACT AMENDMENT (MAY 74): Notwithstanding any other provision of this contract, the minimum wage payment shall be as specified by P.L. 93-259 or the applicable Service Contract Act Wage Determination Rate, if any, whichever is greater. INSURANCE REQUIREMENTS: In addition to any insurance which may be legally required, the Contractor and any subcontractor shall procure and maintain during the entire period of performance under this contract the following minimum insurance coverage: (see FAR 28.307-2) a. General Liability Insurance: The limits for bodily injury liability insurance shall not be less than $500,000 per occurrence. b. Automobile Liability Insurance. The limits of bodily injury liability insurance shall not be less than $200,000 per person and $500,000 per occurrence, and limit for property damage liability insurance shall not be less than $20,000 per occurrence on the comprehensive form of policy. c. Worker's Compensation and Employer's Liability Insurance shall not be less than $100,000. PAYMENT BY CREDIT CARD: The Government will process payments monthly under this contract through the Government's Credit Card System. Within 3 working days after the beginning of each month, the Contractor shall submit to the Contracting Officer a Summary of Services performed during the preceding month. The Summary of Services shall contain as a minimum the following: name and address of the Contractor; date, contract number; contract line item number; item description, quantity, unit of measure, unit price and extended price of the item(s); and the name, title, and telephone number of the person to call in the event of discrepancies in the summary. A separate summary shall be submitted for services performed at the golf course (line items 0001AD and 0001AE). The monthly summaries shall be submitted in lieu of the invoice specified in FAR Clause 52.212-4(g). The Contractor shall maintain the capability to accept the Government Credit Card during the life of the contract. The Contractor will only be paid for actual services performed. Any deduction due to deficiencies will be withheld in accordance with terms in FAR Clause 52.212-4(a). PERMITS AND RESPONSIBILITY FOR WORK: The Contractor shall, without additional expenses to the Government, obtain all licenses and permits required for the prosecution of the work. The Contractor shall be responsible for all damages to persons or property that occur as a result of his/her fault or negligence in connection with the prosecution of work. PERMITS, TAXES, LICENSES, ORDINANCES, AND REGULATIONS: Contractor shall obtain all necessary permits, give all notices, pay all license fees and taxes, comply with all Federal, state, municipal, county and local Board of Health ordinances, rules and regulations applicable to the business carried on under this contract, and be responsible for all applicable state sales and use taxes. PROOF OF INSURANCE: 1. At all times during performance, the Contractor shall maintain with the Contracting Officer either: (a) a current Certificate of Insurance (COI) showing at least the insurance required above and providing for a firm 30 day written notice to the Contracting Officer by the insurance company prior to cancellation or any material change in policy coverage. The statement that "failure to provide such notice relieves the insurance company of any liability" shall not be written into the COI. (b) A certificate of compliance, executed by an officer of the Contractor's firm, certifying that the firm will comply with the insurance requirements stated in this contract at all times during performance of this contract. (a certificate of compliance will be provided to the Contractor upon contract award). 2. A Certificate of Insurance from the Contractor's insurance company or a Certificate of Compliance shall be furnished to the Contracting Officer 10 calendar days prior to contract performance. 3. Failure to maintain the required coverage may result in termination of the contract. TRADOC PROTEST RULES: (a) Offerors filing a protest may now file their protest to HQ, TRADOC as an alternative to filing the protest with the Contracting Officer (b) Interested parties are encouraged to consult with the Contracting Officer before initiating protests. If the parties cannot resolve their dispute, the interested party may file an agency protest. There are two agency protest forums available to interested parties (1) A Contracting Officer protest and (2) a HQ, TRADOC protest. An interested party may file with one forum or the other, but not both. (c) A copy of the TRADOC Protest Rules will be furnished to interested parties upon request. VEHICLE REGISTRATION: The Contractor will be required to register Contractor-owned vehicles and its employees will be required to register privately-owned vehicles in compliance with AR 190-5 as directed by the Contracting Officer. ADDENDUM TO 52.212-1: ACQUISITION PROCEDURES: This acquisition is solicited under Commercial Item Simplified Acquisition procedures specified in FAR Part 13.5, Test Program for Certain Commercial Items. ALL OR NONE: Offeror is required to submit an offer on all CLINs. Failure to do so will be cause for rejection of the offer. CLARIFICATION OF THIS SOLICITATION: Offerors are cautioned against soliciting views, clarification, interpretations, etc., of this solicitation from agencies or individuals of the Government other that the issuing office. Submit requests for clarification via e-mail to rodenasd@sill.army.mil. Oral explanations will not be binding. EVALUATION AND AWARD: The Government will evaluate offers in response to this solicitation and award a contract to the responsible offeror whose offer conforming to this solicitation, will be most advantageous to the Government considering price and past performance. Past performance is more important than price. Award will be made based upon the best value to the Government in accordance with procedures in FAR 13.106-2(b). NOTICE OF AWARD: A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. REFERENCES: Offerors shall submit with their offer at least 3 references that the Government may contact to evaluate past performance. The reference sheet shall include (1) company name (2) mailing address (3) point of contact and telephone number (4) contract number or title of project (5) dollar amount of contract.
