Description

The United States Marine Corps has a requirement to establish a second source of supply for the procurement and delivery of 200,000 pair Multipurpose Overboots (MULO). It is in the interest of national defense to establish a second source of MULOs to ensure the continuous availability of this protective equipment and to have suppliers available for furnishing the required supplies and services in the event of national emergency or for industrial mobilization. To accomplish this, pursuant to Federal Acquisition Regulation (FAR) 6.202(a), DFAR 206.202 and NAPS 5206.26, it is necessary to exclude Tingley Rubber Corporation, 200 South Avenue, PO BOX 100, South Plainfield, NJ 07080, the sole current manufacturer of MULOs, from competing in this procurement. It is anticipated that a firm-fixed price contract will be awarded during 2nd Quarter of Fiscal Year 2002 on the basis of full and open competition after exclusion of the above source and pursuant to guidance set forth at FAR 16.202, which provides the standard definition of a firm fixed price contract.
