- + 24 May 2001 This is the Military Sealift Command, Sealift Program Management Office, Washington, DC Subj: RFP N00033-01-R-5505 Ref: (A) SF1449 (B) MSC DRYTIME 99 (REV 5/99) Time charter of a U.S. flag with coastwise endorsement, self-sustaining heavylift vessel(s) to move cargo among U.S. West Coast ports, Hawaii, and the Far East. US flag and VISA participants to be given preference in accordance with the Cargo Preference Act of 1904 and Section IIIA.3 of the Voluntary Intermodal Sealift Agreement (VISA) at 62 Federal Register 8214-8222 dated 18 FEB 1999. MSC Sealift Program Management Office, Code PM52P, requests proposals for a vessel capable of meeting the requirements described below. References below apply to the box layout of Ref (A) and Ref (B) which are incorporated by reference (available from the MSC web site, http://www.msc.navy.mil/N10/conthp.htm, under "Library of Common Documents", or upon request), which shall be the charter form of any contract resulting from this solicitation. Payment Will Be Made By: Commander, Military Sealift Command, N86, Washington Navy Yard, Bldg. 157, 914 Charles Morris Court SE, Washington, DC 20398-5540. II. DRYTIME Boxes Vessel Required: U.S. flag with coastwise endorsement, self-sustaining heavylift vessel(s) to move cargo among U.S. West Coast ports, Hawaii and the Far East. Vessel must have a minimum speed of 11 knots; minimum bale capacity of 185,000 cu. ft.; and minimum of 20,000 sq. ft. of clear, unobstructed, useable deck space. Vessel must have a minimum crane lift capacity of 175 metric tons. Vessel must be capable of carrying M-140 containerized hazardous (radioactive) cargo, refueling facility equipment (for cargo only), and M1A1 tanks. Vessel must have adequate supply of lashing and securing for useable breakbulk space and full load of containers. Lashing gear for M1A1 tanks to be provided as Government-furnished equipment. 2. Place/Range of Delivery: Oakland, CA. 3. Place/Range of Redelivery: Oakland, CA. 4. Charter Period: Initial period of 2 years with Government option to redeliver after six (6) months with 60 days prior notice. 5. Laydays: Commencing -- 01 JUL 2001/Cancelling 1 SEP 2001 to be narrowed by Government prior to award. 6. Terms/Conditions/Attachments added, deleted or modified: V(a) -- Security Clearance; ADD. V(b) -- Communications Equipment; ADD. V(c) -- Navigational Equipment (delete (iii) and (vii); ADD. ADD article V(k) as follows -- "V(k) -- Slot charters with Department of Energy. The owner agrees that at any time, and from time to time during the period of this charter, at the direction of the charterer, owner shall enter into slot charter arrangements with the United States Department of Energy (DOE) for the movement of hazardous cargo containers aboard the vessel. Such slot charter arrangements (I) are to be entered into by the owner for the owner's account; (ii) Shall be for only such space on the vessel as the charter directs; and (iii) shall be fixed at such portion of the daily rate identified in boxes 14A or 15A of this charter as the space made available to the DOE under such slot charter arrangements bears to the total space available to the charterer under this charter, provided that the total aggregate hire payable to the owner under such slot charter arrangements and under this charter shall not exceed or be less than the daily charter rate identified in Boxes 14A or 15A of this charter. Any space made available for any such slot charter at the direction of the charterer shall be deemed to be space reserved to the owner under Article III(h) (1) of this charter party for such period as necessary to complete the owner's obligations under such slot charter arrangements as required by the charterer." IX Attachments -- IX(c) -- (l) and IX(o), I ADD. XI(a) (5)(i), (ii) and (iv) DELETE. XI(b); Is changed in its entirety to read: "The Contracting Officer shall determine what combination of cost and past performance is of best value to the Government. Cost to the Government shall be deemed more important than past performance. However, in the case of two approximately equally priced offers, superior past performance may allow award to the offer representing higher cost to the Government." XI(c); DELETE. III. Fuel Consumption cost to be evaluated at the minimum speed of 11 knots for laden at-sea time of 368 days and in port time of 362 days, and to be included in the evaluated cost the Government under XI(a)(4). IV. Instructions to Offerors Offerors shall use the guidelines set forth in Part X for submission of offers; however, at a minimum, offers must contain the following: 1.
