Description
Amendment 001 for Solicitation Number USSS010014 is issued to amend the Solicitation as well as to respond to questions received. The Solicitation is amended as follows: Under Federal Acquisition Regulation (FAR) clause 52.216-19, Order Limitations, the insert is amended to state the following in consecutive order: "100 each", "1,000 each", "1,000 each", "7" and "7" . Under FAR 52.217-9, Option to Extend the Term of the Contract, the insert is amended to state the following in consecutive order: "within 15 days of the option period", "30", and "two years and six months". Question #1: Is 1,000 Minimum, 1,500 Maximum per order or total per year? Does Option Year 1 and Option Year 2 minimums change from 1,000 to 100 and maximums change from 1,500 to 1,000? Answer: For the Base Year Period, which will cover from date of award through September 30, 2001, the total minimum quantity proposed to be ordered is 1,000; the maximum is 1,500. For Option Year 1 (October 1, 2001 through September 30, 2002) and Option Year 2 (October 1, 2002 through September 30, 2003), the total minimum quantity proposed to be ordered each year is 100; the maximum each year is 1,500. Question #2: Does availability for Option Years 1 and 2 change from 10 weeks to 7 weeks? Answer: No. The requirement for delivery remains constant at ten (10) weeks from contract award and issuance of delivery order(s), if applicable, for Base Year Period and Option Years 1 and 2. Also, under FAR clause 52.216-19, Order Limitations, states: "(a) Minimum Order. When the Government requires supplies or services covered by this contract in an amount of less than 100 each, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of 1,000 each; (2) Any order for a combination of items in excess of 1,000 each; or (3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section. ....(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 7 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source." Question #3: Is the option to extend the contract 15-30 days before contract expires? Total length of contract with option is 2 years six months instead of 3 years? Answer: As per FAR 52.217-9, Option to Extend the Term of the Contract, "(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days of the option period; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed two years and six months." Therefore, this applies to the two existing Option Years. The total length of this contract, if both options are exercised, shall not exceed two years and six months. Question #4: Will there be an economical adjustment available for the option years? Answer: No. The offeror is expected to provide a firm fixed price for the Base Year and each of the Option Years. This requires a unit price and total price for maximum order quantities for the Base Year (Line Item 0001); unit price and total price for maximum order quantities for Option Year 1 (Line Item 1001); and unit price and total price for maximum order quantities for Option Year 2 (Line Item 2001). All other terms and conditions of Solicitation number USSS010014 remain unchanged. All responsible offerors shall forward proposal package to U.S. Secret Service, Procurement Division (Suite 6700), Attn: Kelly Curtin, 245 Murray Drive, SW, Bldg. 410, Washington, DC 20223, to be received no later than 3:00 P.M.(EST), Monday, April 23, 2001. Please note: Award is anticipated within thirty (30) days of receipt of proposals.
