- Description
- This is a combined solicitation/synopsis for commercial items description, prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This notice constitutes the only solicitation, a written solicitation will not be issued. The solicitation, No. 263-01-P(BD)-0001, is issued as a RFP. The solicitation/contract will include all applicable provisions and clauses in effect through FAC 97-18. The standard industrial code is 8999, and the business size is 3.5 million. The National Institutes of Health, has a requirement for on-site preventive maintenance, inspection and emergency repair of Government-owned P.E. Applied Biosystems Instruments at the National Institutes of Health in Bethesda, Maryland and any other NIH facility withink a 50- mile radius of the Bethesda campus. The NIH intends to contract with PE Biosystems, Applied Biosystems Division, 850 Lincoln Centre Drive, Foster City, Ca 94404, under the authority of FAR 6-302-1 only one responsible source and no other supplies or services will satisfy agency requirements. P.E. Biosystems is the original manufacturer of the items and is the only contractor that has the technical expertise to provide maintenance and keep the equipment in continuous optimum operation. It is the Government's belief that this requirement can only be met by P.E. Biosystems. The following FAR provisions/clauses are applicable to this solicitation and any resultant contract; FAR provision 52.212-1 Instructions to Offerors-Commercial, applies to this acquisition. Award will be made to the technically acceptable low offer. A completed copy of the provision 52-212-3, Offeror Representatives and Certifications- Commercial Items, is required as part of the offer. The clause 52.212-4 Contract Terms and Conditions- Commercial Items applies to this acquisition..The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes Or Executive Orders-Commercial Items applies to this acquisition. FAR clause 52.217-9 entitled Option to extend the term of the contract applies to this contract. FAR 52.217-5 Evaluation of Options is applicable. FAR clauses 52.216-18, 52.216-19, and 52.216-20 are applicable. The Service Contract Act, FAR 52.222-41, and Fair Labor Standards Act, FAR 52.222-43 are applicable. The Department of Labor Wage Determination 94-2103(Rev.22) dated 9/13/00 is applicable. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the options(s) FAR 52.219-9 Small Business Subcontracting Plan , Alternate II is applicable. A Small Business subcontracting plan needs to be submitted with the contractor's proposal. The Contractor will be paid on a monthly basis after submission of a proper invoice. The contractor shall provide unit prices for the NIH-owned equipment that needs to be maintained. The equipment list will be provided by the Contract Specialist seen below. The laboratory equipment to be maintained will be under the following categories; The Government anticipates the award of an indefinite Delivery, Indefinite Quantity, firm fixed price contract. Sources demonstrating the capability to accomplish the above shall provide pertinent information is sufficient detail to demonstrate their ability to perform. Information furnished should include enough material to conduct a proper evaluation. Respondents will not be notified of the evaluation results.
