Note 22 applies. This is a combined synopsis/solicitation for commercial items prepared in the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The request for quotation number for this acquisition is MDA113-00-T-0020. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquistion Circular 97-19. This is a sole source requirement being pursued with E! Entertainment in accordance with FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. There are two contract line ites for the Armed Services Radio and Television Service to receive broadcast, transfer and satellite distribution rights to 20 episodes of "Celebrity Profile," and 13 episodes of "Homes With Style." The following is a describtion of the requiremts: 1. RIGHTS: (ITEM/S : ALL.) The contractor shall grant the Government (AFRTS) the right to reproduce, distribute, and present the programming on authorized AFRTS television outlets outside the contiguous United States, twice over a period of 3 year(s) from date of initial Government distribution, which will begin no later than one year after delivery. 2. REPRODUCTION: Reproduction shall be accomplished only to the extend required to support the distribution of the programming and may be performed by Government personnel in-house or by commercial duplication contractors at the option of the Government. Commercial duplicators are required to certify to the Government that they adhere to industry practices and standards for control and security of all master and duplicated videotapes. All videotape copies will be erased by the end of the rights period. 3. DISTRIBUTION: distribution to authorized AFRTS television outlets may take the form of videotapes sent via mail or by encrypted satellite transmission (Scientific-Atlanta's PowerVu). 4. PRESENTATION: Non-commercial presentation by authorized AFRTS outlets may be by means of television broadcast frequencies or closed-circuit distribution systems. 5. SERVICING: (ITEM/S: ALL.) The contractor shall deliver, at its expense, EITHER a one-inch Type-C videotape OR a Betacam SP videocassette of program(s), which will be returned within 120 working days at Government expense. For Series, unless otherwise indicated, the first 10 episodes are due on delivery date and then 5 episodes per month until all ordered episodes have been delivered. 6. STANDARDS: Videotapes provided by the Contractor shall be NTSC broadcast quality, English version, meeting broadcast network television content and technical standards. 7. PROMOTIONAL 7 PROGRAM SCHEDULING SUPPORT: The Contractor shall supply any videotape promos or trailers along with program promotional copy and publicity information that may be available. The Contractor also grants rights to AFRTS to utilize short clips from programming (not to exceed two minutes) to produce its own videotape promos. Episode sequencing instructions, US airdates and synopses for each program are to be sent to the attention of Cathleen Booth, AFRTS-BC-DOPT, 1363 Z St. Bldg. 2730, March ARB, CA 92518, or FAX 909-413-2604 or e-mail boothcm@dodmedia.osd.mil. 8. EDITING: The Contractor shall permit AFRTS to delete dated references and/or extraneous material from programs to accommodate delayed airing by AFRTS outlets in various time zones. Extraneous material may be, but is not limited to, commercials, promos for programs not carried by AFRTS, game delays in sports telecasts, etc. Department of Defense directives prohibit AFRTS from editing programming to alter storyline, composition, or intent of editorial content. 9. As used herein, the term "AFRTS" identifies the worldwide Armed Forces Radio and Television Service, which is an activity of the Department of Defense. 10. NOTE: Signature or commencement of performance pursuant to this agreement constitutes certification thatyou have the authority to provide to AFRTS the rights to the programming material set forth herein. 11. Inspection and Acceptance will be at destination. 12. DELIVERY: 01 Jul 00. The following clauses are applicable to this procurement: 52.212-1, "Instructions to Offerors -- Commercial Items"; 52.212-4, "Contract Terms and Condtions -- Commercial Items"; 52.212-5,(Deviation) "Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commerical Items"; 52.225-13, "Restrictions on Certatin Foreign Purchases"; 52.227-18, "Rights in Data -- Existing Works"; 52.232-33, "Payment by Electronic Funds Transfer-Central Contractor Registration"; 52.233-3, "Protest After Award"; 52.253-1,"Computer Generated Forms", DFARS 252.204-7004, "Required Central Contractor Registration"; DFARS 252-212-7001 (Deviation) "Contract Terms and Conditions Required to Implement Statutes or Executive Orders"; 252.225-7001, "Buy American Act and Balance of Payments Program". An addendum to FAR 52.212-2 explains that the basis of award is based on a fair and reasonable price and a determination of contractor responisibility in accordance with applicable regulations. The offeror shall include a completed copy of the provision at 52.212-3, "Offeror's Representations and Certifications -- Commercial Items," with its offer.
