commercial services prepared in accordance with FAR subpart 12.6. This
announcement constitutes the only CBD solicitation. EPA anticipates a
sole source placement. Proposals are being requested and must be
received by 4:30 p.m. PST on August 17, 2000. Submit two copies of the
proposal to Joanne Shea, EPA Region 10, 1200 6th Ave, OMP-148,
Seattle, WA 98101. Period of Performance: 10/1/00-10/1/01. Statement of
Work: Scope: The contractor will process notifications and conduct
inspections of asbestos demolition and renovation sites to evaluate
compliance with applicable Environmental Protection Agency (EPA)
regulations and prepare initial follow-up enforcement letters and
documents, where needed. A general description of the work includes:
performing landfill, complaint, renovation, and demolition asbestos
inspections. Inspections shall include the collection and submittal of
samples for analysis and documentation of findings, including written
reports and photographs. The contractor may be called upon to provide
testimony in hearings and legal proceedings when violations are
discovered. Background: Section 112 of the Clean Air Act (42 U.S.C.,
Section 7412) presents a list of substances that have been designated
as hazardous air pollutants. The standard under which these pollutants
are regulated is known as the National Emission Standards for
Hazardous Air Pollutants, or NESHAP. The asbestos NESHAP is contained
in Subpart M of 40 CFR Part 61. The activities under this contract will
assist EPA in ensuring compliance by the regulated community in Alaska
and in gathering the evidence necessary to take appropriate
enforcement action against those who do not comply. All individuals
performing inspections and determining compliance with the asbestos
NESHAP shall be properly trained, in accordance with EPA requirements.
Training and maintaining technical skills is considered a part of this
contract. The contractor is expected to supply all equipment necessary
to perform asbestos compliance inspections, in accordance with worker
protection and other applicable regulations. Objective: The objective
of this contract is to have a credible inspection and enforcement
presence in Alaska, which will ensure compliance with the asbestos
NESHAP by the regulated community in the state.Tasks:The contractor
shall perform the following tasks: 1. The contractor shall process
asbestos demolition/renovation notification forms as follows: a.
Notification forms will be mailed or hand delivered by owners or
abatement operators to the contractor. Notifications will be date
stamped upon arrival. Faxed revisions will be date stamped, and an
acknowledgment of receipt will be faxed back to sender. b. The
contractor will screen the notifications for established inspection
targets, such as size of job, proximity to populated areas, past
violations by the abatement contractor, and other criteria. c. The
contractor will call the notifier if there are questions about the
information contained in the notification, or if the notification is
incomplete. The contractor will, with the assistance of EPA if
necessary, determine if the errors can be corrected with a phone call
or if the notifier needs to resubmit the notification. d. The
contractor will enter the notification information into the Asbestos
Contractor Tracking System (ACTS) database on a weekly basis. e. The
contractor will submit summary reports of notification data to EPA
Region 10 on no less than a monthly basis. f. The contractor will
prepare and submit via e-mail to EPA Region 10 a summary report of
notification, inspection, and enforcement data for EPA's National
Asbestos Registry System (NARS), 45 days after the end of each quarter
(i.e., February 15, May 15, August 15, and November 15). 2. The
contractor shall respond to personal visits, telephone, and written
requests for information about asbestos from the public, regulated
community, and other local, State or Federal agencies.a. The contractor
will answer general questions and send out forms,regulations, and other
guidance documents. EPA Region 10 will provide copies of standard EPA
forms and guidance documents.b. The contractor will determine any
notable pattern or frequency in questions or information requested, so
that new guidance material might be developed by EPA and the
contractor to address this information. The contractor will assist EPA
in preparing the information. EPA will be responsible for printing and
duplication costs of new guidance documents developed for distribution
to the public and the regulated community. c. The contractor will
initially get assistance from EPA Region 10 Seattle staff, Alaska
Operations Office (AOO) staff, or the EPA Headquarters asbestos
ombudsman in answering the more technical questions. The contractor
will be expected to respond to technical questions with minimal
assistance within three to six months of the start of the contract
period. 3.The contractor shall conduct inspections of demolition and/or
renovation sites and asbestos landfills. a. Conduct on-site inspections
according to requests from Regional EPA staff and the inspection
prioritization strategy . Inspections shall be performed during actual
abatement, or -- for demolitions -- prior to and during demolition if
possible, in order to be counted as a completed inspection. All
inspections shall be performed unannounced unless otherwise instructed
by Region 10. For emergency situations, the contractor may be
requested to perform inspections within hours of becoming aware of the
emergency. b. Each inspection shall result in a completed inspection
checklist using a form provided by Region 10. Whenever violations are
suspected or found, a formal narrative report also will be prepared,
following a format provided by Region 10. Inspection checklists shall
be submitted to Region 10 within 15 calendar days of inspection.
Inspection reports shall be submitted to Region 10 within 45 calendar
days of inspection. Violations shall be verbally reported to Region 10
as soon as practical after discovery. (If a single project is
inspected more than once, only one report needs to be submitted, with
the number of inspections being the total times the project was
visited.)c. When alleged violations are discovered, at least two
samples of suspected asbestos containing material shall be collected
and chain of custody procedures shall be followed. Samples will be
analyzed by EPA's Manchester lab. Containers and chain of custody forms
shall be supplied by Region 10.d. Photographs of the abatement site
shall be taken, including areas where samples are obtained, when
alleged violations are discovered.e. For pre-demolition asbestos
inspections where friable asbestos containing material is discovered,
Region 10 shall be immediately notified of the findings.f. For one of
every five inspections, on average, the contractor shall accompany the
waste hauler to the waste disposal site to assure compliance with
vehicle marking, transportation, and waste disposal regulations. The
contractor may also be requested to review record keeping procedures at
the landfill. 4. The contractor shall carry out the following
activities in support of EPA's enforcement actions. a. Draft warning
letters for Region 10 review, concurrence, and signature. 1. Determine
if violations are unlikely to be developed into a formal case, with
consultation with Region 10 as necessary. 2. Determine responsible
party(ies) to whom correspondence should be addressed and mailed. 3.
Prepare a draft letter, based on standard letter and using case and
violation-specific language. 4. Send letter(s) to Region 10 for
concurrence and signature. b. The contractor inspectors shall assist as
required by Region 10 in obtaining all information to support case
development. Inspectors shall testify in those cases that go to
