from 10pm to 6am daily, including all holidays. The contractor will be
given at least two weeks notice of change of schedule, with any new
schedule remaining in effect for at least 30 days. Duties will include
the monitoring of dam gauges. The requirement is for an UNARMED guard,
licensed for the State of New York, in accordance with SOW item 11c.
The quote is based upon an 8-hour day, for a contract period of one
base year and three option years. This procurement will be evaluated
for the best value to the Government; i.e., lowest price will not
necessarily be the determinative factor. The Government will evaluate
the vendor's past performance, length of experience, and capability to
perform the current contract. Failure to comply with any of the
instructions herein may be grounds for finding a quoter non-responsive
and, therefore, ineligible for award, regardless of price. The
contemplated contract is a "Nonpersonal services contract", subject to
the ServicesContract Act, Federal Acquisition Regulations (FAR)
clauses for commercial items, FAR 52.212-1 through 5, and Wage
Determination No. 94-2367, Rev. 12 (note category 27101, Guard I). The
unit price quoted will be firm; however, payment will be made for
actual hours worked. The Government will not make advance payments,
therefore quoters should not condition quotes on advance payment
discounts. This procurement is reserved for small businesses. However,
if the Government determines that quotes from small businesses are
non-responsive or not at a fair and reasonable price, quotes from large
businesses may be considered. The SIC is 7381, with small business size
standard of maximum average of not more than $9 million gross revenues
per year for the last three years. The solicitation may be limited to
the first ten (10) EDI or written responses. BY RESPONDING TO THIS
REQUEST FOR QUOTE, THE QUOTER IS CERTIFYING THAT IT IS NOT A
QUASI-MILITARY AGENCY, IN ACCORDANCE WITH THE FOLLOWING PROVISION, FAR
37.109, Servicesof Quasi-Military Armed Forces: "Contracts with
'Pinkerton Detective Agencies or similar organizations' are prohibited
by 5 U.S.C. 3108. This prohibition applies only to contracts with
organizations that offer quasi-military armed forces for hire, or with
their employees, regardless of the contractor's character. An
organization providing guard or protective services does not thereby
become a 'quasi-military armed force,' even though the guards are armed
or the organization provides general investigative or detective
services. (See 57 Comp. Gen. 524.)" At the time of submission of quote,
Quoters MUST also provide: 1) a "Resume of Experience", as per SOW item
17(b) ("Bidder shall supply a brief resume of previous and current
performances, over a five-year period, listing the agencies and
companies with whom they have contracted, their addresses, the contract
numbers, and the manpower level required for each contract"); and 2)
with respect to SOW item 3, quoters are to submit name(s) and
address(es) of the contract manager(s), AT THE TIME OF QOUTE (and not
within seven days after award of the contract as stated in the SOW).
Quoters must be particularly mindful of SOW item 2.j: "The Contractor
shall assign a company representative as contact point of for liaison
between the Contractor and the Contracting Officer's Representative
("COR") on a 24-hour basis. This company representative is to
physically visit the site at random no less than twice monthly and
submit, in memorandum form, the results of such visits to the COR."
Faxed quotes are acceptable. Quotes must be received by the closing
date of 5pm New York Time, 3 December 1999 to 212-264-3013, Attention
Michael McHugh. It is the quoter's responsibility to verify that the
Government received the quote by the closing time. The original must
follow by mail. (Vendors using EDI are reminded that they ensure that
their quotes are submitted through their respective networks in a
timely fashion, such that the quotes are received by the Government
prior to the time set for closing of quotes.) When returning your
quote, only return The first four pages of the RFQ, along with all
other documentation as required therein. Before award can be made, the
winning vendor must be registered in the CCR (Central Contract

or call 1-800-334-3414. FAR 52.232-19, AVAILABILITY OF FUNDS FOR THE
NEXT FISCAL YEAR (APR 1984): Funds are not presently available for
performance under this contract beyond 30 September 2000. The
Government's obligation for performance of this contract beyond that
date is contingent upon the availability of appropriated funds from
which payment for contract purposes can be made. No legal liability on
the part of the Government for any payment may arise for performance
under this contract beyond 30 September 2000, until funds are made
available to the Contracting Officer for performance and until the
Contractor receives notice of availability, to be confirmed in writing
by the Contracting Officer. (END OF CLAUSE.) Basis of award: 52.217-5,
EVALUATION OF OPTIONS (JUL 1990): Except when it is determined in
accordance with FAR 17.206(b) not to be in the Government's best
interests, the Government will evaluate offers for award purposes by
adding the total price for all options to the total price for the basic
requirement. Evaluation of options will not obligate the Government to
