COMMERCE BUSINESS DAILY ISSUE OF NOVEMBER 15,1999 PSA#2475GOOD FAITH ANNOUNCEMENT -- FPI PRODUCTION OF PLASTIC TARGETS FEDERAL
PRISON INDUSTRIES, INC. (FPI) Under the terms of FPI's expansion
guidelines, published March 12, 1997, in the Federal Register and March
25, 1997, in the Commerce Business Daily, FPI submits the following
"good faith announcement" for public notice and comment. FPI proposes
to manufacture plastic targets for sale to the Federal government. FPI
wishes to begin production of plastic targets used by the Department
of Defense. The targets have a National Stock Number (NSN) beginning
with "6920." This places the targets in Federal Supply Classification
(FSC) code 6920 -- Armament Training Devices. Under FPI's expansion
guidelines, an item's FSC code is the primary determinant of what
constitutes a specific product. FPI has a history of producing items
within FSC 6920. Those sales have been for cable assemblies and related
components for armament training devices. FPI's guidelines state that
in some cases, an item may be considered separate from another product
in the same FSC code if its function differs substantially. In such
cases, the four-digit Standard Industrial Classification (SIC) code may
be used as a back-up measure to more accurately define the product. The
SIC code for this item is 3089 -- Plastic Products Not Elsewhere
Classified. FPI has a history of sales within SIC code 3089. Since FPI
already produces items in both the FSC code and SIC code for plastic
targets, this item does not meet the definition of a "new product." The
targets should be included within the specific product "FSC 6920 --
Armament Training Devices." However, FPI recognizes that a reasonable
person may construe plastic target to be a different specific product
from any items currently produced by FPI. Under the terms of FPI's
expansion guidelines, interested parties may submit comments regarding
this proposed production by FPI. In submitting comments to FPI, the
following guidelines will apply: 1) Comments will be due within 21 days
of the date of this notice; 2) Relevant comments will focus on and
address why the item should be considered a new product, separate and
distinct from similar items currently produced by FPI; 3) While the
primary purpose of the comments will be to determine if the item should
be defined as a new product, comments related to market share and/or
the impact resulting from such a production decision may also be
considered relevant. All comments received in response to this
announcement will be considered by FPI. All commenters will be advised
whether FPI decides to initiate the public involvement guidelines
process. Any interested party has a right to raise any question at any
time with FPI's Board of Directors. All comments should be addressed
