NOTICE OF INTENT TO NEGOTIATE A SOLE SOURCE CONTRACT-LEGAL SERVICES This is NOT a request for proposals. The Export-Import Bank of the United States intends to negotiate a short-term sole source contract for services of an independent attorney (Maria Douglas, Memphis, TN) to assist in the following types of transactions: (i) Aircraft and Project Finance (involves the most complex legal and capital structures of Bank supported financings); and (ii) Latin American long and medium term financings. The attorney shall be responsible for structuring, negotiating and drafting the financing documentation for these transactions. Due to the lack of time to orient a new attorney, this attorney shall be required to have knowledge of existing cases. Some of the skills required include in-depth knowledge and experience in each of the following areas: (i) secured transactions law, creditors' rights, trade finance (including letters of credit), finance lease structures, asset based lending, limited recourse financing, and aircraft finance; (ii) Export-Import Bank Act of 1945, as amended; and (iii) current Bank policies and programs related to aircraft and project finance to include Bank credit administration procedures.
