The National Institute of Standards and Technology (NIST) intends to negotiate with the Diano Corporation of Woburn, MA on a sole source basis to upgrade the existing Diano X-Ray Diffraction Unit (NIST property No. 511454, Diano Model XRD-8536) located in Room A109, Building 231, NIST, Gaithersburg, MD. The contractor shall install the upgraded unit and train NIST personnel in its operation and maintenance. Diano Corporation is the only manufacturer of the existing unit and possesses proprietary design, engineering, service and maintenance information concerning the existing unit. Diano Corporation is the only source for compatible hardware components for the unit upgrade. By using Diano Corporation, the Government prevents the risk of receiving a product with divergent technologies that could jeopardize the effectiveness of the final product. This procurement is authorized by Federal Acquisition Regulation (FAR) Part 13- Simplified Acquisition Procedures. This acquisition is under the authority of 41 U. S. C. 253 (c) (1) and 10 U.S.C. 2304( c). The proposed requirement is for supplies or services for which the Government intends to solicit and negotiate with only one responsible source under authority of FAR 13.501 (a), Sole source acquisitions. The procurement document and incorporated provisions are those in effect through Federal Acquisition Circular 97-12. FAR 52.212-1 Instructions to Offerors -- Commercial Items is applicable to this acquisition. The clause at FAR 52.212-4, Contract Terms and Conditions -- Commercial items, applies to this acquisition. Also the clause at 52.212-5, Contract Terms & Conditions required to implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition, including paragraph (b), subparagraphs (11) 52.222.21 (12) 52.222-26, (13) 52.222-35, (14) 52.222-36, (15) 52.222-37, (16) 52.225-3, and (21) 52.225-21 (22) 52.232-33. The Government anticipates the award of a firm-fixed priced purchase order. Interested persons may identify their interest and capability to respond to the requirement or submit quotations. This notice of intent is not a request for competitive quotations. A specification description is available upon request.
