202-690-5552 This is a combined synopsis solicitation for commercial
items prepared in accordance with the format in FAR Subpart 12.6, as
supplemented with additional information included in this notice. This
announcement constitutes the only solicitation; proposals are being
requested in response to the following statement of work and a written
solicitation will not be issued. This is a request for proposal,
RFP-15-99-HHS-OS. This solicitation document and its incorporated
provisions are those in effect through Federal Acquisition Circular
#97-11. The period of performance shall be from the effective date of
contract award through September 30, 1999, with two option years. All
work is to be performed in Washington, D.C. No relocation or daily
travel expenses will be provided. Award of a Task Order type contract
with Labor Hour task orders is anticipated. The government's intent is
to made a single award to one firm for all required types of labor;
however, if firms propose only partial lots, such as only paralegals,
the government will consider making multiple awards to obtain full
coverage. Statement of Work: The DHHS Departmental Appeals Board (DAB)
needs temporary attorney and paralegal services to support its effort
to reduce a backlog of pending health care enforcement cases. The DAB
provides the Administrative Law Judge (ALJ) and Appellate level review
of enforcement actions proposed by DHHS agencies against health care
providers. Cases involve alleged failures of health care providers to
comply with laws and regulations designed to protect federally-funded
health care programs against theft, fraud, and substandard care. Cases
are adversarial proceedings requiring the analysis of complex factual
and legal issues. Remedies may include termination from federal
programs and civil monetary penalties. Cases may require lengthy
in-person hearings. Temporary services are needed to reduce the numbers
of pending cases by providing paralegal and attorney support: 1) to
review case files and review and/or prepare drafts ofnecessary orders,
rulings, and/or decisions; 2) to assist with hearings and management
of the possibly voluminous case records; 3) to assist with docketing of
cases and issuance of DAB correspondence; 4) to assist the DAB's ALJs
by traveling to hearings as needed; 5) to provide legal research as
needed to analyze applicable laws and regulations and Department
policy. The following labor categories will be established for this
effort: Junior Paralegal, Mid-level Paralegal, Senior Paralegal,
Attorney, Senior Attorney, and Clerical Staff. (End Statement of Work)
Proposals will be evaluated on the technical proposal/resumes (34
points), past performance (33 points) and pricing (33 points). The
technical proposal shall consist of a cover sheet on letterhead
stationary listing the RFP being responded to, the offeror's name,
location, and telephone/fax numbers, a brief statement indicating
understanding of the requirements and the resumes of the proposed
personnel being provided. The resumes must indicate and will be
evaluated on the following minimum qualifications: Junior Paralegal --
Paralegal certificate and one year of relevant legal experience. Two
additional years of relevent paralegal work experience may be
substituted for the paralegal certificate. Mid-level Paralegal --
Paralegal certificate and at least two years of relevant legal
experience. Two Additional years of relevent paralegal work experience
may be substituted for the paralegal certificate. Senior Paralegal --
Bachelor's degree and paralegal certificate and at least two years of
relevant legal experience. A law degree may be substituted for the
bachelor's degree and paralegal certificate requirements. Attorney --
Law school graduate; member in good standing of any state bar
(including the District of Columbia); at least two years experience
practicing law. Senior Attorney -- Law school graduate; member in good
standing of any state bar (including the District of Columbia); and at
least three years of experience practicing law including at least six
months of litigation experience. Resumes need not be provided for
Clerical Staff as they will not be included in the technical
evaluation. The firm providing the temporary personnel must list 3
references for past performance evaluation that include a brief
description of services/personnel provided, a contact name and a
current phone and fax number. The services referenced must have been
performed during the last three years and should be similar to the
requested services. The pricing shall be submitted using the following
format. Travel costs mentioned as a possibility in 4) of the statement
of work shall be handled on an as needed/per task order basis and

original and two copies of each). The provision at FAR 52.212-1,
Instructions to Offerors-Commercial, applies to this acquisition.
Offerors must include a completed copy of the provision at FAR
52.212-3, Offeror Representations and Certifications-Commercial Items,
with their offer (as part of the pricing proposal). The clause at FAR
