combined synopsis/solicitation for commercial items prepared in
accordance with the format in Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation; proposals are being requested and a
written solicitation will not be issued. The solicitation number is
263-99-P-(BN)-0028 and is issued as a Request for Proposal (RFP). The
solicitation/contract will include all applicable provisions and
clauses in effect through FAC 97-10. The standard industrial code (SIC)
is 3826 and the business size is 500 employees. The National Institutes
of Health, National Institute of Allergy and Infectious Diseases,
Bethesda, Maryland, has a requirement to acquire one (1) Protein
Biology System II. The NIH intends to contract with Ciphergen
Biosystems, 490 San Antonio Road, Palo Alto, CA 94306, the only known
source for this particular equipment. The equipment shall be capable of
the following unique performance specifications: 1. The system shall
perform surface-enhanced affinity capture (SEAC) using surface-enhanced
laser description/ionization (SELDI) for the quantitative analysis of
trace components (at low femtomole levels) directly from biological
samples. 2. The system shall perform analyses of protein chips
comprising arrays of antibodies to capture diagnostic marker proteins
directly from biological specimens for identification based on
molecular mass. 3. The system shall perform the analysis of one
microliter of unfractionated biological fluid as well as extract to
provide a protein retentate map with a minimum of 300 features (peaks).
4. The system shall purify proteins from complex biological mixtures
directly on the protein chip surface. 5. The system shall perform
on-chip molecular processing, including protein purification, peptide
mapping, C-terminal, microsequencing and post-translational
modification analysis. 6. The system shall be capable of performing
surface-enchanced neat desorption (SEND) for the analysis of low
molecular mass analytes from 0-1,000 daltons. 7. The system shall
provide experimental data in gel-view display format for direct
comparison with gel electrophoresis data. 8. The system shall provide
automated peak integration (digitization) with peak map display and
comparison formats for differential protein display. 9. The system
shall perform analyses of protein chip molecular arrays in a fully
automated mode requiring a minimum of 100 addressable regions per 2mm
of surface area. 10. The contractor shall provide a YEAR 2000 Warranty
for each hardware, software, and firmware product delivered under this
contract. The contractor shall be able to accurately process the data
(including, but not be limited to, calculating comparing, and
sequencing) from, into, and between the twentieth and twenty-first
centuries and for the YEAR 2000 and leap year calculations. Nothing in
this warranty shall be construed to limit any rights or remedies the
Government may otherwise have under this contract with respect to
defects other than YEAR 2000 performance. The Government anticipates
the award of of an Indefinite Delivery, Indefinite Quantity contract,
with a minimum of one (1) system and a maximum of thirty-five (35)
systems, which shall be for Government-wide usage. The period of
performance shall be for twelve (12) months with four (4) successive
renewable twelve (12) month options. Deliveries shall be made FOB
Destination within consigneee's premises to the specified address(es).
The Government desires the initital delivery of one (1) Protein
Biology System II within sixty (60) calendar days after date of
contract award, for delivery to the National Institute of Allergy and
Infectious Diseases. Thereafter, additional instruments will be ordered
as requested by the Government. If the offeror is unable to meet the
desired delivery schedule, it may, without prejudicing evaluation of
its offer, propose a delivery schedule. However, the offeror's proposed
delivery schedule must not extend the delivery period beyond the
Government'sREQUIRED delivery schedule of ninety (90) calendar days
after placement of order. The Government will evaluate based on F.O.B.
Destination and acceptance at Bethesda, Maryland, and the requirements
of FAR 52.214-21 "Descriptive Literature" apply. Proposals/Information
provided must demonstrate the equipment's ability to meet the
specifications described herein. A completed copy of the provision
52.212-3, Offeror Representations and Certifications-Commercial Items,
is required as part of the offer. The clause 52.212-4 Contract Terms
and Conditions-Commercial Items applies to this acquisition. The clause
at 52.212-5, Contract Terms and Conditions Required to Implement
Statutes or Executive Orders-Commercial Items applies to this
acquisition. The Contractor will be paid following delivery, and
acceptance of the equipment. The proposed contract action is for
supplies or services for which the Government intends to solicit and
negotiate with only one source under the authority of FAR 6.302.
Interested persons mayidentify to the Contracting Officer their
interest and capability to satisfy the Government's requirement with a
commercial item within 15 days of this notice. A determination by the
Government not to compete with this proposed contract based upon
responses to the notice is solely within the discretion of the
Government. Information received will normally be considered solely for
the purpose of determining whether to conduct a competitive
