CONTRACT INFORMATION: The US Army Corps of Engineers, Europe District has a requirement for a European Command Wide Energy Savings Performance Contract (ESPC). An ESPC is a method of transferring the design and development costs of energy saving projects to a contractor who will be repaid through the savings generated by those projects. The Corps of Engineers intends to engage no more than five contractors, referred to here as the contractor, to identify, develop, submit, design, install, operate and maintain Energy Cost-Saving Measures (ECSM's) at US facilities through- out Germany. Only those contracors awarded contracts in the initial selection process will be eligible to perform subsequent ECSM task orders under this contract. The scope of the contract will include any ECSM's proposed by the contractor and accepted by the Government. In most cases, the projects identified and developed by the contractor will be pursued via this contract. In some cases, however, the Government may find that taxpayer dollars are available for project development, in which case the contractor may be compensated for the project development assistance provided and the project pursued through Government channels with the project risk falling directly on the taxpayer. The Government intends to award multiple contracts without discussion based upon information contained in the offerors' initial proposals. The initial proposal may include an oral presentation by the offeror; however, the oral presentation will not constitute "discussions." Depending on the quality of the offerors' proposals, it is possible that all awards will be made without discussion. It is equally possible that one or more awards will be made after the initial submittal, with discussions conducted with the remaining offerors in the competitive range, followed by additional awards after best and final offers. It is also conceivable that no awards will be possible without discussions. The resultant contracts awarded from this solicitation will be Indefinite Delivery, Indefinite Quantity (IDIQ) type contracts as defined in Federal Acquisition Regulation (FAR) Part 16.504. Task orders will be awarded under this contract in accordance with the "Ordering" clause of the contract. Task orders may be issued bilaterally; that is, after negotiation with the contractor. This solicitation is for a maximum 10 year contract ordering period. Task orders may be issued to the contractors during this ordering period. The initial ordering period will be for five years, with two additional optional ordering periods for three and two years, respectively. The performance period, that is the maximum time available for the contractor to identify, design, construct, and maintain the approved ECSM, is 25 years. Performance of work specified in an approved task order shall not exceed the time remaining on the 25 year performance period. The estimated total dollar amount of these contracts is $27,500,000. The average value of the awarded contracts may be as much as $5,500,000, if all fivecontracts are awarded; however, the final value of each contract will be based on the contractor's ability to execute projects. The Government cannot guarantee the contractor a minimum dollar amount. The contractor payment is generated from savings, therefore, if the work of the contractor fails to provide the Government a cost savings, there will be no money available to pay the contractor. Additionally, the Government is prohibited by law from paying a contractor if no savings are generated. The "contractor shall incur the costs of implementing energy savings measures, including at least the costs (if any) incurred in making energy audits, acquiring and installing equipment, and training personnel, in exchange for a share of any energy savings directly resulting from implementation of such measures" according to 42 USC 8287. The cost of an ECSM will be borne by the contractor and can only be recovered during the term of the project through verified energy and ancillary cost reductions. In this process the Government guaranties the contractor will be given a fair opportunity and equal consideration for award of task orders; however, no task order will be awarded if it is not economically feasible for the Government or the contractor. The types of projects eligible for consideration under this solicitation include the following: Lighting improvements; Electric motor replacement; Utility monitoring control systems; Day lighting; Building envelope modifications; Solar systems and renewable energy; Chiller improvements; Water heating systems; Heating, ventilating, and air conditioning (not including boilers, chillers, and utility control systems; Electrical or co-generation plants; Electrical peak shaving; Electrical transmission and distribution; Refrigeration; Boiler and furnace improvements; Energy cost reduction through rebates and rate reductions; Water conservation; Miscellaneous. A pre proposal conference will be held after the solisitation is issued to explain this type of contract and the procedures for the oral presentations.
