combined synopsis/solicitation for commercial items prepared in
accordance with the format in Federal Acquisition Regulation (FAR)
Subpart 12.6, as supplemented with additional information included in
this notice. This announcement constitutes the only solicitation;
proposals are being requested and a written solicitation will not be
issued. (ii) The Solicitation Number is 864397 and is issued as a
Request for Proposal (RFP). (iii) The solicitation document and
incorporated provisions and clauses are those in effect through Federal
Acquisition Circular 97-06. (iv) This solicitation is not restricted to
a set-aside. The Standard Industrial Classification Code is 3613 and
the small business size standard is 750 employees. (v) The negotiated
contract will be an indefinite delivery, indefinite quantity (IDIQ)
contract for the purchase of the following items from date of award
through September 30, 1999, and four one-year optional periods:
Contract Line Item Numbers (CLIN) 0001, 2-pole 60 Amp,208 Volt Switch,
Minimum Quantity 30, Maximum Quantity 50; CLIN 0002, 2-pole 20 Amp,
208 Volt Switch, Minimum Quantity 30, Maximum Quantity 150; and CLIN
0003, 2-pole 30 Amp, 208 Volt, Minimum Quantity 5, Maximum Quantity 10.
(vi) The Federal Bureau of Investigation (FBI), Criminal Justice
Information Services Division (CJISD), intends to negotiate a
firm-fixed-price, IDIQ contract for the purchase of
commercial-off-the-shelf (COTS), point-of-use transfer switches for
redundant AC power and Load Bus Synchronization systems for its four
Liebert 3000 UPS systems to maintain synchronization even while
operating on batteries. The CJISD has critical electronic equipment
involved with data processing that requires the reliability of
redundant power sources for continuous operations. The point-of-use
transfer switch shall have the following minimum characteristics: (1)
Less than 8-millisecond transfer time and well within CBEMA and IEEE
standards; (2) Manufactured to UL Standard 1008 for safety;(3) Manual
and automatic transfer capability; (4) Selectable preferred and
alternate input source; (5) Maintenance bypass capabilities; (6)
Adjustable in-phase transfer; (7) Communication Port; and (8) Load Bus
Synchronization for four (4) UPS units. (vii) Delivery shall be within
30 days from receipt of a delivery order and shall be made to the
Federal Bureau of Investigation, CJISD Complex, 1000 Custer Hollow
Road, Clarksburg, West Virginia 26306, to the attention of the
individual who will be identified on the delivery order. Items shall be
shipped F.O.B. Destination. (viii) The provision at FAR 52.212-1,
Instructions to Offerors -- Commercial, applies to this acquisition.
(ix) The provision at FAR 52.212-2, Evaluation -- Commercial Items,
applies to this acquisition. ADDENDUM FAR 52.212-2, Para. (a) The
following factors, listed in descending order of importance, shall be
used to evaluate offers: technical capability of the item offered to
meet the Government requirement, price, and past performance. Technical
capability and past performance, when combined, are equal to price. (x)
Offerors shall include a completed copy of the provision at 52.212-3,
Offeror Representations and Certifications -- Commercial Items, with
the offer. (xi) The clause at FAR 52.212-4, Contract Terms and
Conditions -- Commercial Items, applies to this acquisition. ADDENDUM
FAR 52.212-4: Offerors are requested to provide pricing based on
quantity discounts, if available; i.e., Qty. 1-5, 6-10, 11-15, etc.
Offerors shall also include pricing for both rack-mounted and
standalone versions of the switches. The following additional FAR
clauses are incorporated by reference: FAR 52.216-18, Ordering and
Addendum to Para. (a) Such orders may be issued from date of award
through September 30, 1999 or during any one-year optional period for
the following four years; FAR 52.216-19, Order Limitations and Addenda
to Para. (a) When the Government requires supplies or services covered
by this contract in an amount of less than a quantity of one each, the
Government is not obligated to purchase, nor is the Contractor
obligated to furnish, those supplies or services under the contract,
Para. (b) (1) Any order for a single item in excess of a quantity of
150, (2) Any order for a combination of items in excess of a quantity
of 200, (3) A series of orders from the same ordering office within 30
days that together call for quantities exceeding the limitation in
subparagraph (b) (1) or (2) of this section, and Para. (d)
Notwithstanding paragraphs (b) and (c) of this section, the Contractor
shall honor any order exceeding the maximum order limitations in
paragraph (b), unless that order (or orders) is returned to the
ordering office within 10 days after issuance...; FAR 52.216-22,
Indefinite Quantity and Addendum to Para. (d) Any order issued during
the effective period of this contract and not completed within that
period shall be completed by the Contractor within the time specified
in the order. The contract shall govern the Contractor's and
Government's rights and obligations with respect to that order to the
same extent as if the order were completed during the contract's
effective period; provided, that the Contractor shall not be required
to make any deliveries under this contract after October 31, 2003; FAR
52.217-5, Evaluation of Options; FAR 52.217-9, Option to Extend the
Term of the Contract, and Addendum to Para. (a) The Government may
extend the term of this contract by written notice to the Contractor
within 30 days of the first day of the next option year. . . and (c)
The total duration of this contract, including the exercise of any
options under this clause, shall not exceed five years.; and FAR
52.232-18, Availability of Funds. (xii) The clause at 52.212-5,
Contract Terms and Conditions Required to Implement Statutes or
Executive Orders -- Commercial Items, applies to this acquisition. The
additional FAR clauses cited in Clause 52.212-5 which are applicable
to this acquisition are: (1) 52.203-6, Restrictions on Subcontractor
Sales to the Government, withAlternate I (41 U.S.C. 253g and 10 U.S.C.
2402); (3) 52.219-8, Utilization of Small Business Concerns and Small
Disadvantaged Business Concerns (15 U.S.C. 637 (d)(2) and (3)); (7)
52.222-26, Equal Opportunity (E.O. 11246); (8) 52.222-35, Affirmative
Action for Disabled Veterans and Veterans of the Vietnam Era (38 U.S.C.
4212); (9) 52.222-36, Affirmative Action for Workers with Disabilities
(29 U.S.C. 793); (10) 52.222-37, Employment Reports on Disabled

103-187). (xiii) Additional contract requirements -- Year 2000
Warranty. The Contractor represents that the following warranty applies
to products provided under this contract/order/BPA. The Contractor
warrants that the products provided under this contract/order/BPA shall
be able to accurately process date/time data (including, but not
limited to, calculating, comparing, and sequencing) from, into, and
between the twentieth and twenty-first centuries, and the years 1999
and 2000 and leap year calculations. The duration of this warranty and
the remedies available to the Government for breach of this warranty
shall be as defined in, and subject to, the terms and limitations of
the manufacturer's standard commercial warranty or warranties contained
in this contract or the applicable End User License Agreement, provided
that notwithstanding any provision to the contrary in such commercial
warranty or warranties, the remedies available to the Government under
this warranty shall include an obligation by the Contractor to repair
or replace any such product whose noncompliance is discovered and made
known to the contractor in writing at any time prior to June 1, 2000 or
for a period of six months following acceptance, whichever is the later
date. Nothing in this warranty shall be construed to limit any rights
or remedies that the Government may otherwise have under this contract.
This warranty shall not apply to products that do not require the
processing of date/time data in order to function as specified in this
contract/order/BPA. (xiv) DPAS rating: N/A. (xv) CBD numbered notes:
N/A. (xvi) Offers shall be submitted by 4:30 p.m. local time, November
30, 1998, to the FBI, CJISD Complex, 1000 Custer Hollow Road,
Clarksburg, West Virginia 26306-0111, Attention: Susan J. Smith, Module
D3. An original and two copies of each offer shall be submitted. (xvii)
