Patent and Trademark Office, plans to award a sole source simplified
acquisition to Marymount University to obtain academic and counseling
services for Marymount students enrolled in PTO's Corporate Learning
Institute known as Patent and Trademark University (PTO-U). The PTO,
Office of Human Resources requires the contractor to assume
responsibility for the on-site provision of academic services and
program advisement to students enrolled in classes or a course of study
through Marymount University. Marymount University has the primary
bachelor's program within the PTO-U curriculum structure and therefore
requires expert level of knowledge of academic counseling, Marymount
University program, policy and procedures as well as authority to
render final and binding decisions regarding various academic
counseling, placement and articulation questions. The contractor shall
provide on-site educational services in conformity with academic
requirements established and prescribed by Marymount University, its
accrediting agency, and its governing board, which meets the
educational needs of PTO-U; apply admission, transfer, grading,
probation, tuition, and graduation policies and requirements as
established in the Marymount University Catalog and Student Handbook;
provide appropriate on-site support for PTO-U staff for registration,
placement testing, and professional educational counseling/academic
advising on a mutually agreeable basis consistent with the requirements
of Marymount University and PTO-U programs; provide for admission of
students of any sex, race, age,color, handicap, national/ethnic origin,
to all the rights, privileges, programs, and activities generally
accorded or made available to students; and administer Marymount
educational policies, admission policies, scholarships and loan
programs, employment or athletic and or other school administered
programs without discrimination on the basis of sex, race, color,
handicap, national/ethnic origin or age. Pursuant to the authority and
guidance underFederal Acquisition Regulations Part 13, the Contracting
Officer has determined that the proposed acquisition is within the
simplified acquisition threshold, that the services needed by PTO are
available from only one responsible source, and that the circumstances
for a small business set-aside do not exists, and as such, the
proposed purchase order will be negotiated using simplified acquisition
procedures on an unrestricted sole source basis. This is neither a
request for proposal nor request for quotations and a competitive
