The contract will be negotiated pursuant to 10 U.S.C. 2304 (c)(1). ASB is the only known company that currently possesses the in-depth technical knowledge and equipment necessary to manufacture the MK50 Thermal Batteries with the required minimum life of 25 years. No other sources have the technical qualifications and necessary resources to perform the work described herein, nor will any other supplies or services satisfy the Navy's performance and acceptance requirements.
