This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation No. DTCG47-98-Q-3EFK55 is issued as a request for quotations (RFQ) pursuant to FAR Parts 12 and 13. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular No. 97-04. This solicitation is unrestricted in accordance with the Small Business Competitiveness Demonstration Program. Proposals are due no later than 4:30 p.m. on July 17, 1998 in Norfolk, VA. FAR Provision 52.212-1, Instructions to Offerors-Commercial; is incorporated by reference. Evaluation criteria pertinent to FAR Provision 52.212-2, Evaluation-Commercial Items, include (1) Technical capability including past performance and personnel qualifications; and (2) Cost. Technical capability is significantly more important than cost or price. Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with their offers. FAR Clause 52.212-4, Contract Terms and Conditions-Commercial Items is incorporated by reference. FAR Clause 52.212-5, Contract Terms and Conditions-Commercial Items, is applicable. The services are required to provide litigation support services. The initial award is anticipated to be for development of as-planned, as-built, and as-properly extended schedules; analysis of work delays and manpower loading; and trial preparation including expert testimony. Proposals shall provide loaded hourly and overtime rates supported by documentation demonstrating the composition of each loaded rate including rates for major cost elements such as overhead, G&A and any other, pursuant to FAR 15.403-3. Additional services may be required at the rates established at award and may include, but are not limited to, preparation of a database to support analysis and a tracking system for documents related to disputed issues; analysis of loss of productivity impact costs and subcontractor impact costs including identification of factors impacting productivity; development of should-cost analysis; entitlement analysis including determination of merit and quantum for all disputed issues; assistance to attorneys in technical preparation and analysis of interrogatories, depositions, discovery pleadings, and pretrial presentation before the Department of Transportation Board of Contract Appeals; technical assistance at trial; development of physical models, graphic presentations, and other supporting documentation; identification of litigative risks, recommendations regarding settlement, and assistance with settlement negotiations. Proposals shall include a cover letter, table of contents, and information regarding (1) technical support services focusing on schedule analysis, productivity analysis and negotiations and ability to support a cost-effective negotiated result and an effective litigation presentation; (2) past performance regarding similar work performed within the past seven years including costs for each contract, point of contact, and information regarding the issues and resolution of each referenced contract; (3) project management and team organization including resumes and information on resources, programs, and methods used to achieve performance effectiveness; and (4) cost information including hourly rates with back-up documentation.
