San Diego is issuing its intent to issue a combined
synopsis/solicitation for a commercial service prepared in accordance
with the format in subpart 12.6 as supplemented with additional
information included in this notice. This announcement constitutes the
only solicitation; A WRITTEN SOLICITATION WILL NOT BE ISSUED, THIS IS
THE ONLY SOLICITATION. Proposals are being requested with this
announcement. The solicitation number for this requirement is
N00244-98-Q-0182. This solicitation and incorporated provisions and
clauses are those in effect through Federal Acquisition Circular 46.
This solicitation is issued as a Total Small Business Set-Aside per FAR
52.219-6; all eligible, responsible sources may submit an offer. The
Standard Industrial Code is 8322 with a small business standard of $5
million dollars. The requirement is for EEO services for the CBC in
Port Hueneme CA as per the attached statement of work: STATEMENT OF
WORK / EQUAL EMPLOYMENT OPPORTUNITY COUNSELORS / BACKGROUND: CBC has
been actively engaged in the Federal Equal Employment Opportunity (EEO)
Program since 1972. The program has been frequently updated in an
effort to ensure full compliance and implementation with applicable
laws and regulations. Under Title VII of the Civil Rights Act of 1964,
as amended by the EEO Act of 1972, individual applicants and employees
who perceive that they have been the victim of discrimination based on
their race, color, religion, national origin, sex, physical or mental
disability, or reprisal may file a discrimination complaint in an
effort to seek redress. Complaints are processed in accordance with
regulations promulgated by the Equal Employment Opportunity Commission
(EEOC) and the Department of the Navy (DON). It is both DON and CBC
policy that EEO issues are resolved at the earliest stage feasible, and
the lowest level possible. Since approximately 1988, CBC has set forth
actions designed to implement its commitment to assure equal
employment opportunity for all employees in all aspects of the
Command's operations. These actions were initially delineated in CBC's
FY 88 -- 92 Multi-year Affirmative Employment Program Plan, and each
succeeding Plan. The primary objective of CBC's EEO Program is to
achieve a workforce, which reflects the ethnic and gender diversity of
our surrounding communities labor force. DESCRIPTION: The contractor
shall provide support to the CBC EEO Program. This support may include,
but no necessarily be limited to, the following: 1. Provide EEO
Counseling to CBC employees, and employees of all CBC tenant activities
covered under this contract, as well as applicants for employment at
both CBC and the aforementioned tenant activities, as directed by CBC's
Deputy Equal Employment Opportunity Officer (DEEOO). Such counseling
will include personal interviews with all parties relevant to the
individual assignment; review of all appropriate official personnel
files (OPF's), other personnel records, as appropriate (e.g., merit
promotion packages, files relating to employee adverse actions, etc.),
management correspondence, and information available in the DCPDS data
base. Counseling will be conducted in accordance with standards
established by the Department of the Navy and the Equal Opportunity
Commission (EEOC). a) At the conclusion of each counseling assignment,
the contractor will provide the CBC DEEOO a file containing all
documents required by DON and EEOC, as well as a Final EEO Counselor's
Report, and a "CATS" intake for with all information germane to the
individual assignment completed. The Final Counselor's Reports will
contain a summary sheet identifying the relevant dates germane to the
inquiry, a brief synopsis of the basis, issues alleged, management's
response, summary of any data analysis and a listing of all parties
interviewed (showing name, organization code, job series, title and
grade, race and gender designator, age (if appropriate), and telephone
extension). b) Each counseling assignment will be considered complete
once the final EEO Counselor's Report is approved by the CBC DEEOO. 2.
Develop such reports as requested by the CBC DEEOO. These reports may
include, but not be limited to, various annual reports required by the
DON, EEOC, Office of Personnel Management (OPM), or senior management.
DCPDS data, as germane to each report, will be provided by the CBC
DEEOO. Analysis of both past and current employment related data may be
included as part of such tasking. 3. Develop presentation materials for
briefings as tasked by the CBC DEEOO. Documents may include, but not be
limited to, simple charts, flow diagrams, illustrations and comparative
data. Training of contractor personnel in current EEO regulations and
practices, EEOC and Federal District Court decisions impacting on
interpretations of Title VII case law analysis to assist in the
handling of employee complaints may be performed by the contractor and
the CBC DEEOO. APPLICABLE DOCUMENTS: 29 C.F.R. PART 1614, OCPM INST
12713.2A (EEO COMPLAINTS MANUAL, EEOC MD-713, EEOC MD-714 PERSONNEL
QUALIFICATIONS: Contractorpersonnel involved in these tasks must
possess graduate level academic course work in management, business or
human resources, or a minimum of six (6) years of related experience
at the appropriate level. Personnel utilized as EEO Counselors must
additionally possess specific experience in facilitation or mediation.
DELIVERABLES: EEO Counselor's Complaint File -- Within two (2) weeks
of final interview, EEO Counselor's Final Report -- Within two (2)
weeks of final interview, Presentation Materials -- As requested,
Reports -- As requested. The service shall start on June 3, 1998 and
run through September 30, 1998 as the base year and two option years
(1st option 98 OCT 01 thru 99 SEP 30 & 2nd option 99 OCT 01 thru 00 SEP
30). The provision at FAR 52.212-1, Instructions to Offerors --
Commercial Items applies. Offerors are required to complete and include
a copy of the following provisions with their proposals: FAR 52.212-3,
Offerors Representation and Certifications -- Commercial Items. Clause
52.212-4, Contract Terms and Conditions -- Commercial Items, applies as
well as the following addendum clauses: FAR 52.211-5, New Material. The
clause at 52.212-5, Contract Terms and Conditions Required to Implement
Statutes or Executive Orders -- Commercial Items applies with the
following applicable clauses for paragraph (b): FAR 52.222-26, Equal
Opportunity; FAR 52.222-35, Affirmative Action for Special Disabled and
Vietnam Era Veterans; FAR 52.222-36, Affirmative action for Handicapped
Workers; FAR 52.222-37, Employment Reports on Special Disabled Veterans
and Veterans of the Vietnam Era. DFARS 252.212-7001, Contract Terms and
Conditions Required to Implement Statutes or Executive Orders
Applicable to Defense Acquisitions of Commercial Items, applies with
the following clauses applicable for paragraph (b); DFARS 252.225-7001,
Buy American Act and Balance of Payment Program; and DFARS
252.225-7012, Preference for Certain Domestic Commodities. The
government intends to make a single award to the responsible offeror
whose offer is the most advantageous to the government considering
price and price related factors. Provision 52.212-2, Evaluation --
Commercial Items, applies with paragraph (a) completed as follows:
Award will be made to the offeror that meets the solicitations minimum
criteria for technical acceptability at the lowest price. To be
determined technical acceptable, the Offeror must submit documentation
as described above that demonstrates your ability to follow the SOW
above. All offerors are to submit your pricing, payment terms, cage
code, Dun and Bradstreet number, TIN, and all applicable specifications
regarding this solicitation. Quotes must be received no later than 3:00
