synopsis/solicitation for commercial items prepared in accordance with
the format in Federal Acquisition Regulation ( FAR) Subpart 12.6, as
supplement with additional information included in this notice. This
announcement constitutes the only solicitation; quotes are being
requested and a written solicitation will not be issued. The
solicitation documents and incorporate provisions and clauses in effect
through Federal Acquisition Circular (FAC) 97-02. This solicitation is
issued under Simplified Acquisition Procedures (SAP), FAR subpart 13,
including the test Program and is 100% set aside for small business.
The Standard Industrial Classification is 3999 and Business Size
Standard is 500 employees. The solicitation is issued under Request for
Quotation (RFQ) # 80068. The contract is a Firm Fixed Price, Indefinite
Delivery-Indefinite Quantity Contract for one year plus four (4) one
year options. The guaranteed minimum requirement for CLIN number one
(1) is 3,000 with a maximum of 18,000 Individual Protective Devices
(IPDs). Specifications: CLIN # 1: INDIVIDUAL PROTECTIVE DEVICES (IPDs):
The Individual Protective Devices (IPD) shell be one (1) ounce for duty
use, 1/2 ounce for concealed carry. IPDs shall contain between five (5)
and 5.5 percent Oleoresin Capsicum (OC) that is entirely natural
pepper. Synthetic OC formulations will be unacceptable. The preferred
carrier for the OC is Isopropyl Alcohol. Other carriers may be
considered and evaluated. The OC utilized in the product must be at
lease 1.5 million Scoville Heat Units. The OC shall not be blended with
other chemical agents such as chloroacetophenone or
O-Chloro-Benzylidene-Malononitrile. No known carcinogenic substance or
hazards materials banned by the Environmental Protective Agency shall
be present in the aerosol. The color of the container should be black,
with a florescent orange dot on the label near the product brand name
to indicate that the device contain OC. The IPDs shall be constructed
of materials that are durable that can withstand daily carrying as
typical in law enforcement situations where rigorous activity is
common. The IPDs shall be actuated depressing a trigger, other
actuators may be considered. The trigger when released will stop the
dispersion of the OC. The unit must be capable of multiple shots. The
IPDS shall have a label describing the contents (percentage by weight)
and bear any appropriate warnings regarding the use of the device.
This label shall also provide a scale to determine the remaining amount
of aerosol left in the container. The amount of OC left in the unit can
be determined by a float test in water using the scale on the label.
The IPDs shall be equipped with a holster, constructed of nylon, that
shall incorporate a safety device to prevent accidental discharging of
the IPD. The holster shall also be equipped with a belt clip designed
to prevent the lose of the unit during a physical struggle. The shelf
life for the IPDs shall be three -five years and the expiration date
shall be marked on each IPD in a manner that the date will not be
rubbed off from daily carry. The IPD shall disperse a cone-shaped mist
for a distance of 10-12 feet, at this distance, the diameter of the
cone shall be approximately six (6) feet. The offeror shall provide the
Material Safety Data Sheets (MSDS) with any product submitted for
evaluation. The offeror shall provide laboratory reports regarding
safety and performance testing of the product that has been conducted
by and independent laboratory, and other related information such as
training materials, videos and instructor training. CLIN# 2, LARGER
TACTICAL OC UNITS six (6) ounces or larger, with lock-down
capabilities: A guaranteed minimum of 3,000 units and a maximum of
18,000 units. Specification for CLIN #2: The same criteria cited above
for IPDs shall apply. The unit shall have an actuator that can be
locked into position, the actuator shall also have the capability of
being unlocked, this should not occur if the unit is tossed on to a
hard surface. The unit should have a continuous spraying time of no
less than 25 seconds and no more than 45 seconds and have the
capability to disperse OC into large indoor area. The unit shall be
actuated by depressing a trigger or button and shall have a safety
system to prevent an accidental discharge. The unit shall have
features, such as a tube, which permit introductions of OC into an
enclosed area. The tube size should equal the size of orifice ofd the
unit to allow for quick dispersion. The unit should disperse a
cone-shaped mist for a range of 20-25 feet. At this distance, the
diameter of the cone shall be approximate 12 feet. FOB- Destination to
FBI, Training Unit, Quantico,VA., Delivery begins 30 ARO. Warranty one
year or better. The FBI reserves the right to make multiple awards. The
award (s) will be made to the responsive, responsible offeror
submitting the lowest priced technically acceptable offer and meeting
all terms and conditions set forth in this solicitation. The following
FAR Provisions are applicable: 52.212-1-Instructions to offers --
Commercial Items (JUNE 1997), 52.212.3 offers Representations and
Certifications Commercial Items (JAN 1997). The following FAR Clauses
are applicable: 52.212.4 Contract Terms and Conditions -- Commercial
Items (MAY 1997), 52.212-5 Contract Terms and Conditions Required to
Implement Statutes of Executive Order -- Commercial Items (AUG 1996),
52.216-22 Indefinite Quantity (OCT 1995). Copies of the FAR Provisions
