NETHERLANDS: ARTICLES 2 AND 3 OF THE DRAFT REGULATION ON THE WIRETAPING OF DCS 1800 MOBILE TELECOMMUNICATIONS SYSTEM COMBINED WITH GSM The following notification is being circulated in accordance with Article 10.6. G/TBT/Notif.97.423. 1. Member to Agreement notifying: NETHERLANDS. If applicable, name of local government involved (Articles 3.2 and 7.2). 2. Agency responsible: Ministry of Transport and Public Works. Agency or authority designated to handle comments regarding the notification can be indicated if different from above: National Enquiry Point. 3. Notified under Article 2.9.2. 4. Products covered (HS or CCCN where applicable, otherwise national tariff heading. ICS numbers may be provided in addition, where applicable): Telecommunications infrastructure for providing public, mobile telecommunications services using DCS 1800 combined with GSM, provisions and equipment. 5. Title, number of pages and language(s) of the notified document: Articles 2 and 3 of the Draft Regulation on the Wire-Tapping of DCS 1800 Mobile Telecommunications System Combined with GSM. (Available in English). 6. Description of content: Article 2: In the general (tracing) interest, wire-tapping requirements are prescribed for the installation of the telecommunications infrastructure of licence holders for DCS 1800 combined with GSM. Article 3: The provisions and equipment which licence holders use to pass on wiretapped telecommunications shall comply with the technical protocol of the authorities on behalf of whom the telecommunications in question have been wire-tapped. 7. Objective and rationale: Since licence holders for DCS 1800/GSM are responsible for providing a country-wide public telecommunications service, they need to help with the wire-tapping telecommunications sent through their network in the general (tracing) interest. 8. Relevant documents: Article 13 of the Mobile Telecommunications Permits Decree, as this will read after the coming into force of the draft Decree amending the Mobile Telecommunications Permits Decree regarding the introduction of a system for public, digital cellular mobile telecommunications over land (DCS 1800). 9.
