synopsis/solicitation for commercial items prepared in accordance with
the format in FAR Subpart 12.6, as supplemented with additional
information included in this notice. The announcement constitutes the
only solicitation; bids are being requested and a written solicitation
will not be issued. The solicitation document and incorporated
provisions and clauses are those in effect through Federal Acquisition
Circular (FAC) 90-46. This solicitation is being issued as a Request
for Quotation (RFQ) #70314. This solicitation is under the Simplified
Acquisition Procedures (SAP) utilizing the Test Program, on an
unrestricted basis for other than maximum competition. The Standard
Industrial Classification (SIC) is 3483, and the size standard is based
on 1,500 employees. This will be a Firm-Fixed Price Contract. The
Government intends to purchase on a brand name basis 500 cases of
Product Number BC40NT2 with option to purchase an additional 500 cases,
contingent upon availability of funds, ballisticlean stranded non-toxic
.40 caliber ammunition (1000 rounds per case) manufactured and patented
by Federal Cartridge Company in Anoka, MN. The prospective offer must
meet the brand name specification as follows: have a pojectile made of
Zinc, and contain no lead, the design to consist of a stranded Zinc
projectile, caliber 40 Smith and Wesson, bullet grain -- 135 jacketed
grain Close Quarters Training, primer: 100Toxic Metal Free (TMF),
velocity in feet per second (to the nearest 10) muzzle 1190,
25yds/1150, 80 yds/1110, energy in foot-pounds (to nearest 5
foot-pounds) muzzle 425, 25yds/395, 50yds/370, mid-range trajectory
25yds/0.2, 50yds/0.8, test barrel: four (4) inches. The objective of
this contract is to obtain the ammunition to be used by new Agent
trainees and field agents during live fire training being conducted on
indoor, outdoor, and shoothouse ranges. Based on market research, it
has been determined that this is the only brand name product that fully
meets the FBI's requirement when utilized on the indoor FBI Academy
range with a wet plate passive trap, and does not bounce back or plug
up the water vents due to its unique projectile stranded design. In
order to maintain a safe, lead-free, indoor range condition, non-toxic
ammunition is mandated. Interested persons may identify their interest
and capability to respond to the requirement or submit proposals. This
notice of intent is not a request for competitive bids. However, all
bids received within fifthteen (15) calendar days after date of
publication of this synopsis will be considered by the Government. A
determination by the Government not to compete this proposed contract
based upon responses to this notice is solely within the discretion of
the Government. Information received will normally be considered
solely for the purpose of determining whether to conduct a competitive
procurement. Delivery is expected 90 days after receipt of order.

if your bid is not received by the date/time and at the location
specified in this annoucement, that it will be considered late. Each
offeror shall include a completed copy of the FAR provisions at
52.212-1 Instructions To Offerors-Commercial Items (October 1995),
52.212.3 Offeror Representation and Certifications -- Commercial Item
(January 1997); FAR Clauses 52.212.4 Contract Terms and Conditions --
Commercial Items (May 1997), 52.212-5 Contract Terms And Conditions
Required To Implement Statutes Or Executive Orders-Commercial Items
(August 1996) is incorporated by reference and applies to this
acquisition. Technical acceptability will be determined solely on the
content and merit of the information submitted by the offeror in
response to this notice. Fax proposals will be accepted at (202)
324-3767, proposals must state name, address and solicitation number.
A techncially acceptable proposal must clearly show that the offeror
can meet the requirement of the Government. Contingent upon the Small
Business Administration (SBA) granting a waiver from the
nonmanufacturer rule, an award to be made one day after closing.
