of Engineers, St. Paul District, intends to negotiate with Orrin A.
Holen Construction Company, P.O. Box 126, McClusky, North Dakota, on a
sole-source basis under the authority of 10 U.S.C. 2304(c)(2) as
implemented by FAR 6.302-2, Unusual and Compelling Urgency. To protect
the City of Devils Lake, North Dakota, against flooding, it is
necessary to raise the earthen levees from an elevation of 1450 to 1454
this construction season. The Government plans to accomplish this
requirement as described below by supplemental agreement(s) to an
existing contract for the Devils Lake Levee Raise, Stage 2. The
original contract consists of work to construct approximately 1.9 miles
of levee to elevation 1450 (which provides protection to 1445 plus 5
foot of freeboard) and the construction of two 5,000 gpm pump stations,
including 185,600 cyds of impervious fill and 26,000 cyds of riprap. It
is now necessary to raise the earthen levees from an elevation of 1450
to 1457 from Sta. 200 to 270 and along a new alignment from Sta. 270
for an additional 11,500 feet. Work includes preloading and wick drains
at the location of the East Ditch Pump Station and the placement of
riprap along the levee alignment. This notice of intent is for the
raise to elevation 1454, which is the portion most urgently needed. The
remainder of work will then be competitively bid. The short
construction season in this northern part of North Dakota does not
allow for earthwork past early November. Therefore, it has been
determined that there is not enough time for a new contract to be
advertised, awarded, and a new contractor mobilized. In addition,
awarding one or more additional prime contracts for segments of the
work is impractical since the geography, topography, and available road
access make it unlikely that two or more contractors could work in the
project area without interfering with each others operations. The work
covered under this proposed modification will include approximately
377,000 cyds of impervious fill and 48,000 cyds of riprap. This
proposed modification consists of essentially the same type of work and
will require minimal modifications to the technical specifications. The
urgent nature of this requirement necessitates designing the changes as
the work progresses, therefore, no solicitation document exists. No
award will be made on offers/proposals received in response to this
