T -- PUBLICATION OF LEGAL SEIZED PROPERTY SOL BATF 97-14 DUE 052197 POC April Lowe, Contract Specialist or Charles Logan, Contracting Officer on (202) 927-8820 The Bureau of Alcohol, Tobacco and Firearms intends to issue a Request for Proposal (BATF 97-14) on a sole source basis to USA Today, Inc. This action is being done under the statutory authority of the Federal Acquisition (FAR), 41 USC 253(c)(1)-Only One Responsible Source. This is a combined synopsis/solicitation for commercial items prepated in accordance with the format in Subpart 12.6 and supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation document and incorporated provisions and clauses are in effect through Federal Acquisition Circular 90-46. This acquisition will be for the publication of legal advertisements for the purposes of announcing property seizures. The contractor shall publish the legal advertisements in a national newspaper of general circulation and of general interest to the public; that is to include political and businessevents, circulating among the general public in each of the federal judicial districts of the United States. The newspaper should have a circulation of substantial quantities in the judicial districts as set fourth in 28 U.S.C. 81(a) through 28 U.S.C. 130(b). Substantial quantities means a minimum total paid circulation of 2,500 or more copies. It does not included distribution on unsolicited copies. The publication should be published at least weekly. The contractor shall accept from the ATF, Seized Propert Section, five (5) working days prior to publicaton, the text for ad publication, i.e. Monday submission for next Monday publication. The contractor should be capable of receiving the data from the Bureau via electrionic transmission. For each advertisement, new text will be added to the advertisement under the caption "FIRST NOTICE", which will be inserted in the advertisement immediatley after the introductory paragraph. After the advertisement is run, new additional text will be provided to be run unber the caption "FIRST NOTICE", with text previously run under the caption 'FIRST NOTICE"' repeated under the caption "SECOND NOTICE", and the text run under the "SECOND NOTICE", repeated under the caption "THIRD NOTICE". Text previously run under the caption "THIRD NOTICE", will be dropped from succeeding advertisements. Offerors are advised to include a completed copy of the provisions at 52.212-3, Offer Representation and Certification -- Commercial Items, with their offer. The following provisions shall be included in this solicitation: 52.212-1, Instructions to Offerors -- Commericial Items 52.212-4, Contract Terms and Conditions -- Commercial Items, 52.212-2, Evaluation -- Commercial Items. Contractor is cautioned of the possiblity that award may be made without discussion of the proposal received; therefore, the initial offer should be submitted on the most favorable terms from a price/technical standpoint which the Offeror can submit to the Goverment. The contract will be firm fixed price. Contract has a period of performance for 60 months, base period begining date of award and 4 one year option periods. Responses are to reference BATF 97-14 and be addressed to April Lowe at the above address. The response shall be sufficient to permit agency analysis to establish capability to meet these requirements at a lower price that which can obtain from USA Today, Inc. If no affirmative response are received, the government will proceed with negotiations with USA Today, Inc. Numbered Note 22 applies to this synopis. However, responses must be received with fifteen(15) calendar days after publication of this notice in order to be considered by the Government. See Numbered Note 22. (0126)
