COMMERCE BUSINESS DAILY ISSUE OF APRIL 10,1997 PSA#1821N/A This is a combined synopsis/solicitation for commercial items
prepared in accordance with the format in FAR 12.6, as supplemented
with additional information included in this notice. This announcement
constitutes the only solicitation; proposals are being requested and
a written solicitation will not be issued. Solicitation number
F04699-97-R-0043 is issued as a Request for Proposal (RFP). The
incorporated documents and provisions and clauses are those in effect
through Federal Acquisition Circular 90-45 and Defense Acquisition
Circular 91-11. All statutorily required clauses will be included in
any resultant award if not specifically addressed in this combined
synopsis/solicitation. This combined synopsis/solicitation also serves
as a notice of intent to negotiate a firm fixed price contract with
March Instruments Incorporated, 4057 Port Chicago Highway, Concord,
California 94520 on an other than full and open competition basis for
the procurement of a super plasmod, low temperature asher
manufacturedby March Instruments Incorporated. The Contract Line Items
are: CLIN 0001: Super plasmod low temperature asher P/N 015-1203
quantity 9 each. The government intends to negotiate on a sole source
basis in accordance with FAR 6.302-1 (Only one responsible source and
no other supplies or services will satisfy agency requirements). The
super plasmod -- low temperature asher is to be installed on location
and is considered integral to existing systems in place. It is expected
that this procurement will be F.O.B. destination and delivered to
Technical Operations Division/LGS, 6000 Patrol Road, McClellan AFB
95652-1709 within 1 month of anticipated award date of 25 April 97. FAR
52.212-1, Instructions to Offerors Commercial Items (OCT 1995) is
incorporated by reference and applies to this acquisition. The clause
at FAR 52.212-2 Evaluation-Commercial Items (OCT 1995) is incorporated
by reference and applies to this acquisition. The Government will
evaluate the proposal for fairness and reasonableness in accordancewith
FAR Part 15 before making an award. Each offeror shall include a
competed copy of the provision at FAR 52.212-3, Offeror Representation
and Certification-Commercial (JAN 1996) with its proposal. FAR
52.212-4, Contract Terms and Conditions-Commercial Items (AUG 1996) is
incorporated by reference and applies to this acquisition. The clause
at 52.212-5 Contract Terms and Conditions Required to Implement
Executive Orders (AUG 1996) is incorporated by reference, however for
paragraph (b), only the following clauses apply to this acquisition:

(NOV 1995) Offeror Representations and Certification applies. The
clause at DFARS 252.212-7001, Contract Terms and Conditions Required to
Implement Statutes or Executive Orders Applicable to Defense
Acquisitions of Commercial Items (NOV 1995) -- is included by reference
and includes the following -- 252.225-7036 North American Free Trade
Agreement Implementation Act. 252.242-7002, Submission of Freight Bills
for Audit, 252.233-7000 Certification of Claims and Requests for
Adjustment of Relief, 252.225-7014 Preference for Domestic Specialty
Metals. WARRANTY -- The contractor shall extend to the Government full
coverage of any standard warranty normally offered in a similar
commercial sale. Acceptance of the warranty does not waive the
Government's right with regard to the other terms and conditions of the
contract which shall take precedence over the warranty. The warranty
period shall begin upon final acceptance of the items listed in the
schedule. By addendum, the clause at FAR 52.211-5 New Material (MAY
1995 is incorporated. This is a DO rated contract. All responsible
sources may submit a proposal which shall be consideredby the agency.
All questions in regard to this RFP are due by 24 April 1997 and must
be done in writing. All questions submitted at or before the
established time shall be addressed in a future amendment to be
published in the CBD. Questions received after the established time
