in accordance with Article 10.6. G/TBT/Notif. 96.207. 1. Member to
Agreement notifying: NETHERLANDS. If applicable, name of local

responsible: Ministry of Health, Welfare and Sport Agency or authority
designated to handle comments regarding the notification can be
indicated if different from above: 3. Notified under Article 2.9.2. 4.
Products covered (HS or CCCN where applicable, otherwise national
tariff heading. ICS numbers may be provided in addition, where
applicable): Soft drinks. 5. Title, number of pages and language(s) of
the notified document: Exemption Regulation for Soft Drinks which are
High in Caffeine (2 pages, available in English). 6. Description of
content: The Regulation sanctions the use of soft drinks which are high
in caffeine subject to specific labeling requirements. 7. Objective and
rationale: There is an increasing demand from the market for permission
to trade in soft drinks with a high caffeine content. There are no
objections to this, provided that the consumer is sufficiently made
aware of this high content. 8. Relevant documents: Commodity Act
Governing Soft Drinks. 9. Proposed date of adoption: Proposed date of
entry into force: As soon as possible. 10. Final date for comments: 27
