Notice is hereby provided that the National Institutes of Health (NIH), HHS, has implemented an electronic commerce/electronic data interchange capability and has certified interim FACNET in accordance with Subpart 4.5 of the Federal Acquisition Regulation and the Federal Acquisition Streamlining Act, P.L. 104-355. Contracting Offices within the NIH may use simplified acquisition procedures specified in FAR Part 13 for acquisitions up to $100,000, and may utilize FACNET for these acquisitions wherever practicable. This is to further announce that at a date not to exceed 90 days following receipt of ``adequate price competition'' (as defined in FAR 15.804-1(b)(1) for those items being procured via FACNET, NIH contracting offices shall require that offerors respond to all FACNET solicitations via FACNET only, unless otherwise authorized.
