applicable, name of local government involved (Articles 3.2 and 7.2):
2. Agency responsible: Ministry of Health, Welfare and Sport Agency or
authority designated to handle comments regarding the notification can
be indicated if different from above: 3. Notified under Article 2.9.2.
4. Products covered (HS or CCCN where applicable, otherwise national
tariff heading. ICS numbers may be provided in addition, where
applicable): Fairground and playground equipment. 5. Title, number of
pages and language(s) of the notified document: Order on the Safety of
Fairground and Playground Equipment (19 pages). 6. Description of
content: The draft Order on the Safety of Fairground and Playground
Equipment has been amended in a number of instances in comparison with
the original notified draft dated 11 August 1995. In addition to
editorial changes, these amendments include clarifications in the
explanatory note and changes in terms of content of the following
articles. Article 3, second paragraph, governing exceptional provisions
regarding foreign equipment which is operated temporarily in the
Netherlands, is limited to equipment-specific requirements of the
Order. Instructions for use of the relevant equipment, such as the
availability of a Dutch instruction manual or the keeping of a log
book, are deemed as equipment-specific requirements and will, as such,
fall under the scope of exceptional provisions. The duty to look after
the equipment during use, on the part of the owner or holder of the
equipment (e.g. during installation and maintenance), shall, however,
remain applicable in full in respect of foreign licensees. Article 25
has been extended by a second paragraph. Foreign fairground and
playground equipment temporarily used in the Netherlands shall be
subject to registration with the Regional Health Protection
Inspectorate at 's-Hertogenbosch at least 2 x 24 hours prior to each
initial mounting or installation of the equipment on Dutch territory.
This registration duty is absolutely vital in order to enable the
aforesaid inspectorate to provisionally assess whether the relevant
foreign equipment actually meets equivalent requirements. Article 14,
first paragraph, stipulates that the instructions for use which are
required to accompany the equipment, shall be drafted in Dutch. 7.
Objective and rationale: The draft Order has been amended in line with
the advice which the Fairground and Playground Safety Regulation
Commission, being an advisory body in which social interest groups are
represented, has issued regarding the draft. 8. Relevant documents:
Number of previous notification: G/TBT/Notif.95.278. 9. Proposed date
of adoption: 1 July 1996. Proposed date of entry into force: Six months
after date of adoption. 10. Final date for comments: 24 May 1996.
