The Department of Justice, Justice Management Division, intends to negotiate with The Michie Company, Charlottesville, VA 22906, for a subscription for updates and supplements to the 1994 edition of Federal Criminal Trials. The Federal Criminal Trials publication contains copyright protected information which is utilized by Department attorneys as a research and trial preparation tool. The publication contains a complete reference to constitutional protection, federal criminal procedures and the rules of evidence to include narrative analysis of criminal legal problems, case law and statutory law. The information is organized and indexed as an efficient research system. The Michie publication is copyright protected and thus Michie Company is the only known source for this publication. The statutory authority for the proposed procurement is 41 U.S.C. 253 (c)(1), only one responsible source. The proposed requirements contract will supply Department locations nationwide. A solicitation does not exist for this requirement. Interested concerns must respond with written documentation, detailed data and pricing information which clearly demonstrates their ability to perform this requirement. Responses received as a result of this notice of intent shall be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses will not be considered as either proposals or bids. A determination by the Government not to open this requirement to competition based upon the written responses to this notice is solely within the discretion of the Government. The anticipated period of performance under any resultant contract will be one year and may include four (4) one-year options to extend the terms of the contract.
