PROCUREMENT IS TOTALLY SET ASIDE FOR INDIAN-OWNED FIRMS UNDER THE ``BUY
INDIAN ACT'', 25 U.S.C. 47. The Bureau of Indian Affairs, Phoenix Area
Office intends to procure services to excavate soil for sampling, and
analyze to characterize the materials for removal and disposal of the
hazardous substance at San Carlos Irrigation Project (SCIP), O&M yard,
two miles of Coolidge, AZ on Highway 287, Pinal County, Arizona, by
means of a fixed-price contract. The contractor shall furnish all
onsite project management services, quality control, materials,
transportation, equipment and services to remove and dispose of
approximately 1,500 tons of PCB items (i.e., transformers, etc), PCB
contaminated soils and materials, and solid waste. The contractor's
personnel are required to have all the necessary qualification,
permits, and licenses to sample, analyze, remove and dispose of the
hazardous substance as required by the EPA regulations. The contractor
is required to perform an on site investigation necessary to determine
the nature and location of the work and any general and local
conditions which can affect the work or its costs. The contractor is
required to comply with all the requirements associated with the EAP
and Occupational Safety and Health Administration (OSHA). Indian firms
desiring consideration must certify they are ``Buy Indian'' eligible.
Indian means a person who is a member of an Indian Tribe or an Alaska
Native who is 1/4 degree or more Alaska Native blood and either on or
descended from someone on the roll of Alaska Natives pursuant to the
Alaska Native Claims Settlement Act of 1971 (43 U.S.C. 1601 et. seq.
Indian/Alaska Economic Enterprise means any business entity (whether
organized for profit or not) which: (1) is at least 51 percent owned by
one or more Indian(s) or (an) Indian tribe(s); and (2) one or more of
those owners must be involved in the daily business management of the
economic enterprise; and (3) the majority of the earnings of which
accrue to such Indian person(s). These requirements must exist when an
offer is made to a solicitation at the time of award, and during the
term of the contract. Section 7(b) of P.L. 93-638 (25 U.S.C. 450e)
requires that preference opportunities in employment and training be
given by contractors to Indian/Alaska Native individuals and that
preference in award of subcontracts be given to Indian/Alaska Native
economic enterprises. Failure by the contractor to submit a plan for
doing so prior to award and implement same after award shall be
sufficient reason for non-award or termination of contract for default.
