- This notice is being provided pursuant to the Revolutionary FAR Overhaul (RFO) Part 5 (FAR Class Deviation 25-17). The U.S. Department of Homeland Security (DHS), Homeland Security Investigations (HSI), Office of Acquisition Management (OAQ), intends to solicit from a single source under the authority of RFO Part 6.103-1 (FAR Class Deviation 25-11) to Tenergy Corp in Fremont, California, for customized rechargeable lithium-ion battery packs and compatible chargers. The Contracting Officer has determined that the circumstances of the contract action make only one source reasonably available based on the capabilities of the source and the proprietary nature of the products. This notice is for information purposes only and is not a Request for Quote (RFQ). A determination not to compete this proposed contract based on this notice is within the discretion of the Government Contracting Officer. Interested parties that believe they can meet the requirements may respond to this notice. Responses should include a brief description of relevant capability and experience. The Government reserves the right to evaluate all responses received and may determine that an interested vendor is not capable of performing the work required. This announcement may constitute the only notice that will be posted for this acquisition. Marketing brochures and/or generic company literature will not be considered nor evaluated.
