- Set Asides: The proposed contract action will not include a total or partial small business set-aside. Codes for Services or supplies: PSC: C1AA - Office Architect and Engineering � Construction: Office Buildings. NAICS Code: 236220 - Commercial and Institutional Building Construction. This industry comprises establishments primarily responsible for the construction (including new work, additions, alterations, maintenance, and repairs) of commercial and institutional buildings. Description: The Department of the Army, Regional Contracting Office Bavaria is issuing this pre-solicitation notice to identify potential sources for a future Multiple Award Task Order Contract (MATOC) for Design-Build and general construction services in Bavaria, Germany. This is not a solicitation for proposals, and no contract will be awarded from this notice. No reimbursement will be made for any costs associated with providing information in response to this notice. The Government is seeking to prepare qualified and experienced construction firms for a broad range of construction projects for proposal submission. The future solicitation and any resulting contract will be subject to the Federal Acquisition Regulation (FAR). The following clauses are anticipated to be included, among others: FAR 52.225-3, Buy American�Free Trade Agreements�Israeli Trade Act: This clause applies to supplies and construction materials and requires that only domestic end products or designated country end products be acquired for public use. FAR 52.225-5, Trade Agreements: This clause is applicable to acquisitions covered by the World Trade Organization Government Procurement Agreement and various Free Trade Agreements. It allows for the acquisition of U.S.-made or designated country end products. FAR 52.225-11, Restrictions on Certain Foreign Purchases: This clause prohibits the acquisition of items from sources that are from or that will be imported from a prohibited country or region. No award to small business is anticipated, therefore information is not included to explain definitization of equitable adjustments for change orders. All responsible sources may submit a proposal, as appropriate, which will be considered by the agency. The US Government plans on soliciting the first week of June 2026 on SAM.gov. To be considered responsible, contractors must meet the Active Registration requirement in FAR 4.203 Offerors or their product or service must meet certification requirements for conducting business in Germany to be eligible for award.
