- LIMITED SOURCES JUSTIFICATION ORDER >SAT FAR PART 8.405-6 Acquisition Plan Action ID: 36C245-26-AP-0008 Contracting Activity: Department of Veterans Affairs, NCO 5, located at 1 Med Center Dr., Clarksburg, WV 26301, in support of VISN 5 VA Health Care System at 1 Med Center Dr., Clarksburg, WV 26301. Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501. Order against: FSS Contract Number: _V797D-50532 Name of Proposed Contractor: LABORATORY CORPORATION OF AMERICA Street Address: 231 MAPE AVE City, State, Zip: BURLINGTON, NC 27215 Phone: 502-228-8630 Description of Supplies or Services: The estimated value of the proposed action is $540,000.00 LAB REFERENCE TESTING FOR THE CLARKSBURG VAMC TO INCLUDE COURIER SERVICE, DIRECT REPORTING TO VISTA, AND ONSITE PERSONNEL TO PROCESS AND TAKE ORDERS. Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; PROCUREMENT HAS ALREADY BEEN PROTESTED, CONTRACTING OFFICER HAS BEEN INFORMED TO DO ANOTHER SOURCES SOUGHT. THERE IS NOT ENOUGH TIME TO DO ANOTHER SOURCES SOUGHT, GET THROUGH THE COMPETITIVE CONTRACT PROCESS BEFORE THE CURRENT ORDERS EXPIRE. CONTRACTOR IS THE INCUMBANT. Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: The firms FSS pricing was already determined to be fair and reasonable. Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Pricing has already been determined to be fair and reasonable by the NAC. Any Other Facts Supporting the Justification: Louis A. Johnson VA Medical Center is requesting a one-year FSS Order from the previously awarded FSS BPA incumbent for reference laboratory testing for all labor, supplies, equipment, maintenance, information technology, and supervision to provide Reference testing laboratory services to include the following: specimen preparation and storage, transportation of specimens to its laboratory, pre-analytic processing, analysis, reporting of analytic results and consultation. A one-year FSS Order is being requesting to cover services until the new VISN contract is awarded due to being protested. A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None, at this time, however it is the plan for the government to compete this in the future.
