Description
NOTICE OF INTENT TO AWARD SOLE SOURCE PROCUREMENT: The U.S. Army Corps of Engineers (USACE), Albuquerque District, intends to award a new contract for Sutter Basin Project Interpretive Native Plant Garden, Sutter County, CA This will be accomplished on a sole source basis in accordance FAR 13.106-1(b)(1)(i), Purchases not exceeding the simplified acquisition threshold and only one source reasonably available. Services under this contract will include but are not limited to the following: assess existing conditions within the designated Garden space; create conceptual layout and final layout for the Garden space and the content of interpretive signage and/or other materials; install, repair, and replace components of an appropriate irrigation system to supply water to installed vegetation; procure and plant a palette of California native plants determined appropriate for the location and interpretation; install pathways, landscape features, and interpretive signage and/or other interpretive materials; prepare a management plan for the long-term care of the Garden; maintain the Garden and site infrastructure for the duration of the establishment period, to include irrigation maintenance, weed eradication, and replanting in areas where plant survival falls below designated levels. A Memorandum of Understanding (MOU) was established between the US Corps of Engineers, Sacramento District and the Sutter County Museum to develop an interpretive Native Plant Garden. The garden will serve as mitigation under Section 106 of the National Historic Preservation Act, to resolve adverse effects to significant cultural resources caused by the District�s Sutter Basin Flood Risk Management Project in Sutter County. The mitigation was agreed to through consultation among the District, the United Auburn Indian Community, the California State Historic Preservation Officer, the museum, and the Enterprise Rancheria Estom Yumeka Maidu Tribe. A determination by the Government not to compete this proposed requirement is based upon the fact that Enterprise Rancheria, Estom Yumeka Maidu Tribe, a federally recognized Indian Tribe, has the experience for a landscape plan using plant species native to the Sacramento Valley. Enterprise Rancheria possesses the inherent expertise, ancestral, and cultural relevance and ties to the Sutter Basin Project area necessary to develop the interpretive materials for the public and tribal visitors to the garden. These unique requirements are necessary to ensure the Garden meets the purpose and need of the required mitigation, which were established through USACE tribal consultation and specifically developed for the Programmatic Agreement. THIS IS NOT A FORMAL SOLICITATION. This Notice of Intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All submissions will be evaluated for the sole purpose of determining whether competitive opportunities exist. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. All responses received within 15 days will be considered. Late submissions will not be considered. Detailed responses to this notice shall be submitted to the following email addresses no later than 5:00 PM (Mountain Daylight Time), October 15, 2025; Loretta.D.Sanchez@usace.army.mil. Telephone responses will not be accepted. If no submissions are received, the government will proceed with a noncompetitive action. An informational copy of the noncompetitive solicitation will be available IAW FAR 5.102(a) after October 15, 2025, but competitive quotations will not be considered. To obtain a copy of the of the noncompetitive solicitation please email Loretta.D.Sanchez@usace.army.mil. The U.S. Army Corps of Engineers, Albuquerque District, will not reimburse for any costs connected with supplying sufficient detail to demonstrate the ability to comply with the requirement listed. In order to be eligible for award of a Government contract, a firm must be actively registered in the System for Award Management (SAM), have no active exclusions, and complete the FAR and DFARS representations and certifications. Firms must register on a one-time basis, and annually confirm accuracy and completeness of registration information.
