Description
The U.S. Embassy to Ukraine invites all interested responsible vendors to participate in a solicitation for professional landscaping services at the Embassy Compound located at 4 Ihor Sikorsky St. in Kyiv. The required services include installation and repair of irrigation systems, ground leveling, soil and gravel replenishment, and lawn repair- detailed information is provided in the attached Scope of Work. The Embassy intends to conduct a site-visit, and all prospective offerors are invited to attend. The site-visit will be held at 10:00 (Kyiv local time) on April 18, 2025, at 4 Ihor Sikorsky St. in Kyiv. For site-visit registration please provide your company contact information, names of visitors, and names of tools (if any- measuring tape, etc.) no later than 09:00 (Kyiv local time) on April 17, 2025, to KyivSolicitations@state.gov . Payment Terms: According to U.S. Federal Acquisition Regulations (FAR), advance payment is prohibited. Payment will be made upon acceptance of services by the Embassy representative. Pursuant to the Prompt Payment Act of the FAR, the U.S. Government must make the payment within 30 calendar days after receipt of services and the valid detailed invoice whichever occurs later. SAM Registration: According to FAR 4.1102 in case the amount of offer/contract action exceeds $30,000, all prospective offerors should be registered in System for Award Management (SAM): www.sam.gov prior to award of the contract/purchase order and through the final payment. System updates may lag policy updates. The SAM may continue to require entities to complete representations based on provisions that are not included in agency solicitations, including 52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals�Representation, and paragraph (t) of 52.212-3, Offeror Representations and Certifications�Commercial Products and Commercial Services. Agencies will not consider or use these representations. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM. Submission of Offers: The offers must be prepared in English and submitted by e-mail to: KyivSolicitations@state.gov with subject line: �Landscaping, Lawn Repair and Installation of Irrigation System at U.S. Embassy Kyiv (PR12867910)? by 10:00 (Kyiv local time) May 5, 2025. No offers will be accepted after indicated deadline. For an offer to be considered, the following documents in PDF or ZIP format only shall be submitted: (1) General information about the offeror (legal name, address, main types of activities, relevant past performance in providing landscaping services, etc.). (2) Detailed price offer that includes price for each type of work and material, taxes if applicable, and total amount of offer. Vendors may submit their offers in Ukrainian Hryvnyas or in U.S. dollars. Ukrainian vendors will be paid in Ukrainian Hryvnyas; price submitted in U.S. dollars will be converted to Ukrainian Hryvnyas based on official exchange rate of the National Bank of Ukraine on the date of invoice. Other than Ukrainian vendors are eligible to be paid in U.S. dollars if their offer is submitted in U.S. dollars. (3) Detailed information about offered new irrigation system and pop-up sprinklers for replacement, including make and model, quantities, sprinklers layout for the new system showing the area covered by each sprinkler to avoid dry or oversaturated areas. (4) Detailed information on seeds for lawn repair to include manufacturer and seed components. (5) Warranty terms for workmanship and installed materials. (6) Project schedule indicating when the various portions of the work will be commenced and completed within the required period of performance. (7) Confirmation of acceptability of payment terms. (8) Evidence of active SAM registration if applicable. (9) Completed and signed Express NDAA Certification Form (attached) if offeror did not provide this certification during his registration in SAM. (10) Completed and signed Certification Regarding Compliance with Applicable Federal Anti-Discrimination Law (attached); and (11) Written Acknowledgement of Defense Base Act Insurance Requirement. The Defense Base Act Insurance requirement (DBA) will only apply to employees working on this purchase order. The U.S. Department of Labor has issued a geographic waiver of the DBA requirement for employees covered under compulsory workers� compensation laws of Ukraine (Law of Ukraine �On Mandatory State Social Security�). The waiver does not apply to any employees under this purchase order who: (a) is a citizen of the United States of America; or (b) is a lawful resident of the United States of America; or (c) was hired in the United States of America. If the above waiver does not apply, the offeror shall include Defense Base Act (DBA) insurance premium costs covering employees in the offer and procure DBA insurance after award of purchase order. The offeror may obtain DBA insurance directly from any Department of Labor approved providers at the DOL website at https://www.dol.gov/agencies/owcp/dlhwc/lscarrier . The offeror must submit the statement that includes the following information: � whether they will be required to provide Defense Base Act Insurance; � whether employees who will work under this purchase order are insured according to the Law of Ukraine �On Mandatory State Social Security�; � quantity of employees who are (a) citizen(s) and/or (b) lawful resident(s) of the United States of America and/or (c) was hired in the United States of America if any. The U.S. Government intends to award a purchase order to the responsible company submitting an acceptable offer at the lowest price. We intend to award a purchase order based on initial quotations, without holding discussions, although we may hold discussions with companies in the competitive range if there is a need to do so.
