Description
Millennium Challenge Corporation A&F CGM Acquisition Support Services Sole Source Notice The US Millennium Challenge Corporation (MCC) is a United States government-owned corporation created under Title VI of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 2004 and is responsible for the stewardship of the Millennium Challenge Account (MCA). MCC works with developing countries to promote sustainable economic growth to reduce poverty. MCC Contract & Grants Management (CGM) Division requires a bridge contract with Dynamic Pro, Inc. (DPI) to allow the vendor to continue providing acquisition support services to CGM during the pending Attesa Group�s bid protest to the Court of Federal Claims. Total estimated value is $4,199,177.28. The estimated period of performance for this bridge contract is from March 1, 2025 to August 31, 2025 with the FAR 52.217-8 Option to Extend Services through February 28, 2026. This requirement had been competed among 8(a) small business companies. An IDIQ contract was awarded on September 30, 2024. On October 1, 2024, MCC provided post-award debriefings to all five unsuccessful offerors and the one successful offeror following the conclusion of a competitive procurement process. On October 14, 2024, Attesa Group, one of the unsuccessful offerors, filed a bid protest with the United States Government Accountability Office (GAO). After a GAO decision was rendered on January 16, 2025, Attesa Group filed a protest to the Court of Federal Claims (COFC) on January 30, 2025. Given the uncertainty surrounding the duration of the litigation process and potential further delays, MCC must ensure continuity of critical services that would otherwise be disrupted if the new contract remains on hold pending the resolution of litigation. A bridge contract is necessary to: Maintain uninterrupted performance of critical services. Prevent operational delays that could impact MCC�s mission objectives. Mitigate the risk of gaps in contractor support that could result from continued legal challenges. Ensure compliance with procurement regulations while safeguarding the integrity of the acquisition process. In the light of the ongoing bid protest and the need to ensure uninterrupted services, MCC plans to issue a sole source bridge contract as authorized by 41 U.S.C. 3304(a)(2), FAR 6.302-2, Unusual and Compelling Urgency. This authority applies �in those situations where delay in award of a contract would result in serious injury, financial or other, to the Government.� Without the continuity of this support service, MCC will not be able to execute contract actions that promote efficiency and advance the policies of President Trump�s Administration. This approach also minimizes risk to MCC�s operations while adhering to federal procurement guidelines and ensuring fairness in the competitive process. This is not a request for proposals and a solicitation package will not be issued. Sources interested in responding to this requirement must be able to provide compelling evidence that the MCC is improper in invoking the sole source authority for the abovementioned requirement as specified. A determination not to compete this proposed contractual action based upon responses received is solely within the discretion of the Government. Responses must be received via email to the Contracting Officer, Maxwell Sarpong, sarpongmb@mcc.gov and the Contract Specialist, Mami Obeng-Duro, obeng-duroma@mcc.gov by 12.00 p.m. ET on April 2, 2025.
