Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and FAR Part 13, Simplified Acquisition Procedures, as supplemented with additional information included in this notice. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2025-03. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Government intends to award one (1) firm-fixed price award as a result of this solicitation. Request of Quote (RFQ). The Government is soliciting for an RFQ. In accordance with FAR 13. 0004, a quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier�s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs. Debriefs are not authorized under this solicitation. In accordance with FAR13.106-3(d), a brief explanation may be provided when requested. This solicitation requires registration with the System for Award Management (SAM) prior to submission of offer, and at time of award pursuant to applicable regulations and guidelines. Registration information can be found at www.sam.gov. All offerors with an invalid or inactive registration will be removed from the solicitation as ineligible to participate for award. MEET OR EXCEEDS The Buyer requires that Sellers quote using the specification provided within this solicitation. Sellers MUST provide a quote based on the specifications provided by the government. Seller must demonstrate that all offered specification are equal or better in a line-by-line comparison matrix in order to be evaluated. If you are not able to deliver the line item as requested, DO NOT QUOTE. Specifications are provided below. Delivery Requirement: All new ballistic rubber crumb must arrive at FLETC Charleston prior to the close of business (COB) on March 4, 2025. Contractor shall coordinate all deliveries with FLETC logistics personnel. Government personnel will handle unloading and spreading of materials across designated berms. Equipment Condition New Equipment ONLY; No remanufactured or ""gray market"" items. All items must be covered by the manufacturer�s warranty. Shipping Condition Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. Evaluation for Award- The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: price, technical capability, past performance, and delivery of the item offered to meet the Government requirement. The Government will evaluate offers in accordance with FAR 13.106-2 and the buy terms provided in this solicitation. The Contractor shall NOT make partial line-item shipments against any resulting purchase order/contract issued as a result of this solicitation The Contractor must submit an official quote on company�s letterhead to cover all related cost to this solicitation. The Government intends to award one (1) Firm-fixed price purchase order. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-2, Evaluation- Commercial Items; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.225-13, 52.232-34. The full text of the referenced FAR clauses may be accessed electronically at https://www.acquisition.gov/far/. Addendum to FAR Clause 52.212-4(a) Inspection/Acceptance. -Provide 200,000 pounds of new ballistic rubber crumb for replenishment of Firearms Ranges 3 and 4. Any additional may be required and authorized by the POC. Any additional rubber will be at the established contract price with maximum 2-day delivery period. The period of performance will not be extended for any additional delivery. -Material specifications. Any material outside the listed specifications will not be accepted. Free of metal belting, contaminants, or foreign materials. Meets or exceeds federal ballistic safety standards. Packaged and labeled appropriately for safe transport and storage. The contractor shall supply 50 gallons of ballistic rubber crumb fire retardant to enhance fire resistance within training berms in order to be in compliance to federal, state, and local regulations as follows. -Packaging: Packaged in ten (10) 5-gallon buckets to allow controlled application and storage in accordance with at the minimum following specifications. Non-toxic, environmentally compliant formula. Designed for use with ballistic rubber crumb materials. Meets or exceeds industry fire-retardant standards. Contractor must provide Safety Data Sheets (SDS) and application instructions Due to timelines, the deadline for questions is Monday at 0900 ET, February 24, 2025. Ensure to review FAR 52.212-2 of the RFQ for specific requirements.
