- Notice Type: Notice of Contract Action � Siemens Industry Inc � SIEMENS DESIGO SERVICES AND PREVENTATIVE MAINTENANCE. Justification, Statutory Authority: FAR 13.501(a) � 41 USC 1901- Only one responsible source and no other supplies or services will satisfy agency requirements. Contract Award Date: TBD Contract Award Number: TBD Synopsis: The United States Air Force Test Center/Directorate of Contracting (AFTC/PZZG), Edwards AFB, CA intends to issue a sole source contract to Siemens Industry INC, 1000 E Deerfield PKWY Buffalo Grove, Illinois 60089-4547, United States, SIEMENS DESIGO SERVICES AND PREVENTATIVE MAINTENANCE. The contract will be executed by means of other than full and open competition, due to Siemens being the only capable vendor of providing the needed software and maintenance. Siemens also has extensive experience flying in close quarters, in support of or against United States Air Force Aircraft. The authority permitting other than full and open competition is 41 USC 1901 - FAR 13.501(a) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in- (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or (B) Unacceptable delays in fulfilling the agency's requirements. The Electronic Warfare Group (EWG) currently has Siemens systems established and installed in the Joint Simulation Environment at Nellis Air Force Base. The current System is under Warranty through December 30th 2024. The EWG is seeking to extend the servicing and preventative maintenance for these installed systems are they are critical to mission success at this location. The preventive maintenance and other services are proprietary to Siemens with no authorized resellers. During the Market Research stage the manufacturer Siemens was contact to confirm if they have any distributors or resellers and the following response was received �The Siemens Las Vegas Area office/Branch is the only Southern Nevada area/branch that covers this geographic area and as the installing and design team we are the sole source for service.� With this information in mind a Notice of Contract Action will be posted on SAM.gov to confirm that there are no other potential vendors. Siemens products and services have already been extensively used within the Joint Simulation Environment at the Edwards AFB and Nellis AFB locations. Switching to another brand of service or maintenance could result in unexpected downtime from receiving non manufacturer service. Potential switching the entire system to a different would also consist of a large duplication of cost and substantial downtime to switch the systems and retrain current users. All technical data, data rights, and source code are proprietary, and the Government has no claim to this information. In order for the government to develop its own system would be a lengthy and costly process that is not expected to recover or save any future costs. . The Government requests that initial feedback, comments, and questions be submitted no later than three (3) calendar days from the date of this notice posted to www.beta.SAM.gov. In accordance with leeway permitted by FAR 13.501(a)(iii), all responsible sources may submit a capability statement, which shall be considered by the agency. Any response submitted by respondents to this Notice of Contract Action constitutes consent for that submission to be reviewed by Government personnel. The Air Force Test Center has appointed an Ombudsman to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Concerned parties should address their concerns, issues, disagreements, and/or recommendations to the Contracting Officer for resolution prior to consulting the Ombudsman.
