Special Notice Special Notice Page 4 of 4 INTENT TO SOLE SOURCE The Department of Veterans Affairs, Network Contracting Office (NCO) 6, Central Virginia VA Health Care System intends to enter into a sole source, Firm-Fixed Price contract with WAVEMARK, INC, 300 Baker Avenue, STE 207, Concord, Massachusetts 01742-2131, United States, which requires brand name services to include preventative and corrective maintenance. In accordance with U.S.C. 2304( c)(1)(B) as implemented by FAR 13.106-1(b), Soliciting from a Single Source. NAICS 811210- Maintenance, Repair and Rebuilding of equipment. The proposed contract action is to provide a full-service agreement for WaveMark/Cardinal Endoscope/Catheter Equipment as listed below: Item Description Location 1 Vendor is to provide full on-site/remote support to include hardware maintenance, software agreement and support services which includes parts, labor and travel to perform both corrective and preventative maintenance needs for the equipment listed below. (18) RFID Smart Cabinets (1) WaveMark (Smart Wand) (5) WaveMark Workstations The Central Virginia VA Health Care System. This is not a request for competitive offers and no solicitation is available. Market research has determined that this product hold proprietary rights and only available from a single source without an unacceptable delay or duplication of cost and no other type of servicers will satisfy agency requirements. The Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b), Soliciting from a single source. Contract will be for an estimated period of performance 23 December 2024 22 December 2025. This intent announcement is being issued for information purposes only and does not constitute a solicitation or request for competitive proposals. Interested parties may identify their interest in the requirement and capabilities to Contracting Officer Tiara White via email at Tiara.White@va.gov, no later Monday, December 16, 2024 by 10AM EST. Telephone inquiries will not be accepted. All information shall be furnished at no cost or obligation to the government. (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufacture or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. Those interested firms must indicate whether they are large, small, small-disadvantaged, 8(a) or woman owned business and whether they are U.S. or foreign owned. Respondents who submit proprietary data shall clearly mark the data with appropriate markings. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. No solicitation will be made available. The Government will not pay for any information submitted as a result of this intent. This intent shall not be construed as an obligation on the part of the Government to acquire any products or services. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the government not to complete this proposed contract based upon responses to the notice is solely within the discretion of the Government.
