- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC) on behalf of the Center for Cellular Engineering (CCE), Clinical Center (CC) at the National Institutes of Health (NIH) intends to negotiate and award a contract without providing for full and open competition (including brand-name) to: Bethesda-Chevy Chase Orthopedic Assoc. 10215 FERNWOOD RD, STE 506, BETHESDA, MD 20817 NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 621111 with a Size Standard $16,000,000. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2024-05, April 22, 2024. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. GENERAL INFORMATION 1. Title: Orthopedic 24/7 Consultation Services. 2. Background Information: The National Institutes of Health (NIH) is the nation�s foremost federally funded biomedical research institution. It is comprised of twenty-seven Institutes, Centers and Divisions. The NIH Clinical Center is the on-site 242-bed hospital for the NIH campus comprised of clinical, laboratory and administrative staff who support the Institutes as they conduct clinical research working with inpatients and outpatients participating in research studies at the NIH. Whereas the Clinical Center has a clinical support team to address a broad variety of routine medical issues that may arise during a course of treatment, in some instances, a specialist is required for emergency consultations. The NIH does not have a full-time orthopedic surgeon on staff, necessitating a formal agreement with external contractors to provide emergency, urgent and routine orthopedics consultations. The contractor must be able to respond within a two-hour window per service and have ongoing relationship with the CC patients. 3. Purpose or Objective: This is a Direct patient care service to provide 24/7 orthopedic service to Clinical Center and NIAMS patients. The contractor will provide routine, urgent and emergent orthopedic care as determined by the attending physician. Services rendered will include 24/7 routine, urgent and emergent consultation on site. The contractor will discuss the case with the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS) physician and will provide follow-up that meets patient care requirements. Such follow-up care may be provided on-site, or in instances in which transport of the patient is appropriate, care may be provided in a nearby clinic or office setting. 4. Period of Performance: 1/1/2025 � 12/31/2025 CONTRACTOR REQUIREMENTS (SCOPE OF WORK) The contractor will perform all consultative services onsite at the NIH and work at the direction of the patient�s NIH attending physician. The contractor will discuss the case with the NIAMS physician and is expected to respond in person within two hours of notification. Proximity to the NIH is important to facilitate a two-hour response. If surgery is required, the preferred location for surgery is within the designated operating suites and clinics in the NIH Clinical Center. However, if the surgery is beyond the capabilities of the NIH, surgery can be performed at a hospital that has the necessary orthopedics equipment and supplies to promote patient safety. If the patient requires urgent or emergent surgery, the attending physician will discuss the case with the contractor and the NIH anesthesiologist on call to see if the surgery can be performed at the Clinical Center. If the procedure cannot be performed safely at the NIH, the contractor will coordinate with the attending NIAMS physician to arrange for the transfer of the patient to a nearby hospital where the contractor has privileges for surgery. Surgical patients will also be seen by the contractor for a medically appropriate number (minimum of one visit) of outpatient visits to assess post-surgical progress. Follow-up care for postoperative patients will meet the community standard for the provision of orthopedics care. The contractor is required to document all care provided in the patient�s medical record. On-Call schedule The contractor will be available to provide routine, urgent or emergent orthopedics consultations 24/7. The contractor may designate and utilize other members of his/her practice to provide coverage when the primary contractor is out of town to assure proper management of Clinical Center patients. Any member of his/her practice who is designated must meet the requirements stated in the �Requirements� section. Requirements: The contractor must be a skilled orthopedics Board Certified Orthopedic Surgeon with at least five years post-residency experience. Must have familiarity with orthopedic oncologic procedures as well as experience performing procedures on pediatric patients who have genetically determined skeletal disease or bone dysplasia. The contractor will be a licensed in Maryland. The contractor shall be board certified in Orthopedic Surgery. The contractor will provide personal medical liability insurance at the standard $1 million per claim/$3M aggregate. The contractor shall indemnify the Government for any liability producing act or omission by the contractor during the contract performance. Contractors shall not be considered at any time employees of the Federal Government for any purpose. The contractor shall comply with all hospital policies and requirements established by the Clinical Center, or if not at the Clinical Center, then the site of care. The contractor must provide necessary credentialing documents and references for privileges in the Clinical Center. The contractor must provide proof of a negative TB test, and documentation of Hepatitis B vaccination before reporting to work at the Clinical Center. The contractor will complete appropriate Clinical Center competencies. The contractor will adhere to all applicable NIH policies, regulations, and rules, including those of the Clinical Center. Patient Confidentiality Patients have the right to privacy concerning all Clinical Center data. The contractor shall agree to comply with the provisions of the Privacy Act of 1974 (�Act�), as amended, and the agency rules, regulations and policies implementing the Act. Any patient data identified, utilized, or transmitted will be subject to the Act and confidentiality requirements under which the Clinical Center operates. All information pertaining to specific clinical Center patients is protected from unauthorized use or disclosure by the Act. Violation of the Act may involve the imposition of criminal penalties. Clearances The contractor will have access to patient information via Clinical Research Information System (CRIS) and NIH/Clinical Center secure email. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION This acquisition is being conducted under the authority of the FAR Subpart 13.106-1(b)(i), Contracting officers may solicit from one source if t contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The total dollar value of this purchase order shall not exceed the SAT at $250,000.00. Interested concerns capable of providing the same or similar products or services as described in this notice may submit a capability statement outlining their capabilities. Capability Statements must be received within the time set forth in this synopsis to be considered by the Government. A determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
