- DEPARTMENT OF VETERANS AFFAIRS SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5 Acquisition Plan Action ID: 36C245?24?AP?4515 1. Contracting Activity: Department of Veterans Affairs, VISN 05, Hershel �Woody� Williams VA Medical Center 2. Nature and/or Description of the Action Being Processed: Rental and maintenance of the temporary trailer for the Sterile Processing Service after construction has been completed due to staff not capable of moving into the space currently due to other issues. 3. Description of Supplies/Services Required to Meet the Agency�s Needs: The action is to rent a Mobile Sterile Processing System (MSPS) building/trailer that is fully equipped to enable the Sterilization Processing Service (SPS) department to perform the reprocessing needs in support of the operating rooms and clinics at the Hershel �Woody� Williams (VAMC). The contract includes one (1) temporary building/trailer which houses STERIS sterile processing equipment, systems, and all necessary components, as well as the manufacturer�s support maintenance of the equipment during the life of the lease, decommissioning, demolition, and complete removal of temporary building/trailer and all equipment at the end of the lease. The rental agreement is for three (3) calendar months with two (2) three (3) month extension options. The MSPS temporary building/trailer is already situated and in operation and is located on the exterior grounds of the Medical Center. 4. Statutory Authority Permitting Restricted Competition: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. � 1901 and is implemented by FAR 13.106?1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below: (x ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements ( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest 5. Demonstration that the Contractor�s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only One Responsible Source � The Huntington VAMC already has the trailer onsite that was part of the construction project. Construction is complete and the performance period has expired, however there are several issues outside of construction that need to be addrerssed prior to medical staff moving into the completed space. The trailer is owned by KAR Contracting LLC. In order to continue to provide patient care, a rental agreement needs to occur between KAR Contracting LLC and the Government until medical staff can move into the completed space. It is not economically practical to bring in new trailers. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: None 7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Clarksburg VAMC is currently renting a SPS trailer due to issues involving the steam to the Clarksburg VAMC SPS and DC VAMC rented trailers for multiple years during the construction renovation of their SPS. The rental cost of the Huntington VAMC trailer is below the amounts paid for those two locations. Additionally, a rental agreement thru FSS via GSA would cost $73,857.93 per month. The trailer supplied by KAR Contracting LLC will be rented for $40,585 per month with a removal fee of $55,000, which is $176,755 for the base period without the discount. KAR Contractling LLC gave a $5000 discount towards maintenance, which brings the rental for the base period of $171,755. If procured thru GSA it would be $221,573.79, which has already been determined to be fair and reasonable by the Government. Kar Contracting LLC proposal is which is a 29% savings. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The trailer has already been onsite and constructed years ago and met BAA at the time. The CO is aware that multiple companies such as Steris and MMIC have sterilizing processing trailer systems for rent. It is logistically unrealistic to remove the current trailer and install different trailers at this time. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: It is a logical follow on contract that the medical center keeps and rents the existing onsite trailer versus have the existing removed and different trailer(s)placed due to time, money, training of staff and the length of additional time needed by the medical center before the permemant space be occupied. 10.
