Notice Type: Notice of Contract Action � Top Aces CORP � F-16 Chase Support. Justification, Statutory Authority: FAR 13.501(a) � 41 USC 1901- Only one responsible source and no other supplies or services will satisfy agency requirements. Contract Award Date: TBD Contract Award Number: TBD � Synopsis: The United States Air Force Test Center/Directorate of Contracting (AFTC/PZZG), Edwards AFB, CA intends to issue a sole source contract to Top Aces Corp., 7852 E Velocity WAY Mesa, Arizona 85212, for use of their privately owned fleet of F-16s for chase support purposes across Edwards AFB. The contract will be executed by means of other than full and open competition, due to Top Aces being the only capable vendor of providing the needed privately owned F-16s. Top Aces also has extensive experience flying in close quarters, in support of or against United States Air Force Aircraft. The authority permitting other than full and open competition is 41 USC 1901 - FAR 13.501(a) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in- �������������������� (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or �������������������� (B) Unacceptable delays in fulfilling the agency's requirements. This is a sole source acquisition to Top Aces Corp for use of their privately owned F-16s for chase support. The F-16 is a highly specialized and highly capable multi-roll all weather aircraft. Capable of high speeds, advanced aerial maneuvering, and other highly specialized flight characteristics. For a aircraft to provide adequate chase support they must have similar flight capabilities. This limits chase aircraft to the F-16 platform as well. Currently, Top Aces is the only company that can be located that flys demilitarized F-16s in the country. In 2021, Top Aces became the first private company in the world to acquire the F-16, which is considered by many to be the most agile fighter aircraft of its generation.� Its superior speed, acceleration, maneuverability, small visual and radar signature, and ability to integrate advanced sensors and threat systems have made it the aircraft of choice for the USAF and USN Aggressor fleets since 1988. In January 2022, Top Aces upgraded its powerful legacy F-16 airframe with its proprietary Advanced Aggressor Mission System, fielding the first high performance, threat-representative adversary capable of supporting the 5th generation warfighter. Top Aces has often provided support with their fleet of F-16s and other aircraft to act as Aggressors during training exercises to help train American pilots and forces. Top Aces has extensive experience flying in support of and against United States Air Force aircraft and within United States Air Force Airspace. This experience is invaluable for this requirement as they will be in close chase support of Air Force Aircraft. . The Government requests that initial feedback, comments, and questions be submitted no later than three (3) calendar days from the date of this notice posted to www.beta.SAM.gov. In accordance with leeway permitted by FAR 13.501(a)(iii), all responsible sources may submit a capability statement, which shall be considered by the agency. The Air Force Test Center has appointed an Ombudsman to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Concerned parties should address their concerns, issues, disagreements, and/or recommendations to the Contracting Officer for resolution prior to consulting the Ombudsman. Additionally, Air Force Federal Acquisition Regulation (AFFARS) 5352.201-9101 � Ombudsman, will be included in any potential solicitation and contract for this acquisition.
