- Notice Type: Synopsis of Contract Action � McMurray Stern LLC � OSS Life Support Lockers Justification, Statutory Authority: FAR 13.501(a) � 41 USC 1901- Only one responsible source and no other supplies or services will satisfy agency requirements. Contract Award Date: TBD Contract Award Number: TBD � Synopsis: The United States Air Force Test Center/Directorate of Contracting (AFTC/PZZG), Edwards AFB, CA intends to issue a sole source contract to McMurray Stern LLC, 15511 Carmenita Road Santa Fe Springs, California 90670-5609, United States for the installation of QTY 309 custom lockers by Spacesaver Corporation. The contract will be executed by means of other than full and open competition, due to the customized nature of the lockers to support the practicality that is needed for the 412th OSS Aircrew Flight Equipment. The authority permitting other than full and open competition is 41 USC 1901 - FAR 13.501(a). In order to comply with FAR 5.207(c)(15), the reason for lack of competition is as follows: The lockers by Spacesaver Corporation are customized specifically to secure and prevent unnecessary/unwanted bending, folding, creasing or wear & tear from improper storage. Acquiring lockers that do not properly fit the TEST equipment risks damaging about $126,000.00 in equipment per locker. Damage to the equipment may also not be apparent until the equipment is actively in use by the Aircrew. This poses another risk to the safety of the Aircrew while they are mid-flight which can be avoided by acquiring the customized Spacesaver lockers. The design of the lockers by Spacesaver and the installation layout of the lockers by McMurray Stern LLC are proprietary in nature and cannot be shared with the general public. McMurray Stern has sole authority of selling, installing, and servicing Spacesaver lockers for the Edwards Air Force Base area. Any existing Spacesaver system must be moved by a factory trained and certified Spacesaver installer in order to maintain its warranty and the availability of parts. No other party, unless authorized by Spacesaver in writing, other than McMurray Stern LLC is authorized, trained or certified (which is contingent on activating and maintaining warranty) to conduct Spacesaver work in this territory. In addition, warranty is void if work is done by others and no other company can purchase replacement or upgrade parts for the Spacesaver systems. Attempting to acquire the lockers from a vendor who is not an authorized local dealer puts the Air Force at risk for damage of the lockers during installation. If the lockers are not properly installed or damaged during installation, we are also risking damage to Aircrew equipment and the Aircrew themselves if the lockers are not securely installed. Give the information provided above, it is in the Government�s best interest to procure the customized lockers from Spacesaver Corporation to be installed by McMurray Stern LLC. The Government requests that initial feedback, comments and questions be submitted no later than three (3) calendar days from the date of this notice posted to www.beta.SAM.gov. In accordance with leeway permitted by FAR 13.501(a)(iii), all responsible sources may submit a capability statement, which shall be considered by the agency. Any response submitted by respondents to this Synopsis of Contract Action constitutes consent for that submission to be reviewed by Government personnel. The Air Force Test Center has appointed an Ombudsman to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Concerned parties should address their concerns, issues, disagreements, and/or recommendations to the Contracting Officer for resolution prior to consulting the Ombudsman.
